Variance – 1201 County Rd E <br />Gem Lake Planning Commission 9/10/24 <br />August 27, 2024 <br />Page 4 <br /> <br /> <br /> <br />Requirements for stormwater drainage on the property are not unique, as other properties must also <br />balance development and drainage requirements. <br /> <br />Given that the building permit (which included the now as -built shed location) was already reviewed <br />and issued for the project, and the shed has already been built, the applicant is in a unique situation <br />of where they thought the structure was able to be built in its as-built location. <br /> <br />The commissioners should discuss if this criterion is met. <br /> <br />• The variance, if granted, will not alter the essential character of the locality . <br />Other detached accessory structures are located on nearby properties at setbacks from roads similar <br />to the as-built shed. The as-built shed is also partially screened from the road (County Road E East) <br />by existing trees and vegetation and is nearly fully screened from neighboring properties to the east. <br />This criterion appears to be met. <br /> <br />• Economic considerations alone do not constitute practical difficulties. <br />Economic considerations, such as cost, are not mentioned in the applicant’s submittal as the reason <br />or rationale for the request. This criterion appears to be met. <br /> <br />• Practical difficulties include, but are not limited to, inadequate access to direct sunlight for <br />solar energy systems. <br />N/A <br /> <br />Section 17.4.2.2 includes seven criteria for the Planning Commission and City Council to review for variance <br />requests listed below in bold, with the Planner’s findings following. <br />1. Adjacent Uses. <br />The shed in its as-built location does not appear to have negative impacts on neighboring uses and <br />properties. The as-built location would not stand out in comparison to other neighboring properties. This <br />criterion appears to be met. <br /> <br />2. Air and Water Quality. <br />The proposed as-built location does not appear to impact air or water quality of the property or nearby <br />development. This criterion appears to be met. <br /> <br />3. Traffic Generations. <br />Traffic in and out of the site is generated by the principal use of the property, the Montessori School. The <br />shed itself does not generate traffic, as it would be used to store equipment and items used by the school. <br />This criterion appears to be met. <br /> <br />4. Public Safety and Health. <br />The proposed shed in its as-built location does not appear to have any impact on the safety or health of <br />the public. This criterion appears to be met. <br /> <br />5. Area Aesthetics. <br />Other detached accessory structures are located on nearby properties at setbacks from roads similar to <br />the as-built shed. The as-built shed is also partially screened from County Road E East and Labore Road <br />by existing trees and vegetation. This criterion appears to be met. <br /> <br />6. Economic Impact on the Entire Area. <br />The shed being within the side yard setback is not expected to have an economic impact on the <br />neighborhood or the city. This criterion appears to be met. <br /> <br />
