No. 67D has been <br />revised to comply with current requirements. <br /> <br />PROPOSED AMENDMENTS <br /> <br />Section Action Details <br />TITLE Remove “to the city of gem lake municipal code” <br />Definitions <br /> <br />Add 30 Definitions for clarification and consistency with MN State Rules. <br />Replace Flood Plain. changed “the City Floodplain Flood Hazard Ordinance” to <br />“Ordinance No. 114” <br />Remove Per MPCA guidance, the term ‘As-Builts’ can replace the term <br />“Record Drawings.” <br />Upgrade, Repair, <br />Replacement, <br />and <br />Abandonment. <br />Add “Failure to Protect Groundwater. A SSTS that is determined to be <br />failing to protect groundwater in accordance with Minnesota Rules, <br />Chapter 7080.1500, Subd. 4B shall by upgraded, repaired, replaced, <br />or abandoned by the owner in accordance with the provisions of this <br />Ordinance within three (3) months of receipt of a Notice of <br />Noncompliance. In the event of a system failing to protect <br />groundwater, a mitigation plan will be submitted to the department <br />immediately upon discovery. If the Department determines that <br />extenuating circumstances exist, this timeframe may be extended to <br />ten (10) months from receipt of a Notice of Noncompliance.” <br />Amendments to <br />the Adopted <br />Standards - <br />Setbacks <br />Add “Variances to building setbacks included in Minnesota Rules, Chapter <br />7080 and 7081 may only be considered through the normal variance <br />process as outlined in the City’s Zoning Ordinance (Ordinance No. <br />131). Variances to shoreland setbacks may be considered through the <br />Shoreland section of the City’s Zoning Ordinance” <br />Amendments to <br />the Adopted <br />Standards <br />Replace Replaced “licensed Minnesota Professional Engineer” with “an <br />appropriately licensed business, an appropriately certified qualified <br />employee, or a person exempted under part 7083.0700, subpart 1., who <br />is also licensed by the MPCA as an Advanced Designer” <br />in order to comply with MN Rule Chapter 7082. <br />Multiple <br />instances <br />Replace “licensed inspection business” with “a licensed service provider” <br />“service provider or qualified employees” with “inspector” <br />Abrogation and <br />greater <br />Restrictions <br />Replace “It is not intended by this Ordinance to repeal, abrogate, or impair any <br />other existing City Ordinance, easements, covenants, or deed <br />restrictions. However, where this Ordinance imposes greater <br />restrictions, the provisions of this Ordinance shall prevail” with “This <br />Ordinance Replaces Ordinance No. 67C in its entirety.”
