r <br />k <br />2.5 Compliance with the Plan <br />The Comprehensive Plan of Gem Lake is designed to be more than <br />a mere document spelling out general municipal policies. It is <br />principally intended as a deeision-making._ aid primarily for (a) <br />guiding the expenditure of public capital funds and (b) establishing <br />Y <br />the underlying rationale for the development codes and. ordinances <br />which more specifically control private development within the City. <br />s <br />In particular, the Comprehensive Plan is the guiding document of <br />r <br />zoning. <br />Minnesota State Statute 462.356 (Subdivision 2) further spells out <br />required compliance with the plan where putLlLc capital investments. <br />are involved: <br />z <br />'.'After a Comprehensive Municipal Plan or Section.thereof has been <br />recommended by the Planning Agency (the Gem Lake Planning <br />Commission..) and a copy filed with the governing body (the Gem Lake <br />City Council), .no publicly owned interest in real property within the <br />municipality shall be acquired.or disposed of, nor shall any capital <br />improvement be authorized by the municipality or special district or <br />agency thereof or any other political subdivision having jurisdiction <br />within the municipality until after the Planning Agency (City <br />Planning Commission.) has reviewed the :proposed acquisition,. <br />disposal,. or capital improvements and reported in writing to the <br />governing body (City Council) or other special district or agency or <br />political subdivision concerned, its findings as to compliance of tiie <br />proposed acquisition, disposal or improvement with:: the <br />Comprehensive Municipal Plan. Failure of the Planning Agency to <br />report on the proposal within 45 days after such a reference, or such <br />other period as may be designated by the governing body (City <br />CounciI), shall be deemed to have satisfied the requirements of this <br />� <br />subdivision. Thegoverning body (City Council may, b resolution <br />g g y� tY ) Y Y <br />I <br />adopted by two-thirds vote, dispense with the requirements of this <br />subdivision when in its judgment it finds that the. proposed <br />acquisition or disposal of real property or capital improvement has <br />no relationship to the Comprehensive Municipal Plan. " <br />i <br />2.6 Amendments to the Plan <br />The Comprehensive: Municipal Plan of the City of Gem Lake is <br />designed to be amendable. The City Planning Commission has the <br />authority granted by the City Council to annually review the. contents <br />of the Comprehensive Plan. and to recommend any potential <br />amendments to the City Council. Any amendments to the <br />Comprehensive Plan beyond an editorial level will be executed only <br />after a public hearing which is duly advertised in the officially <br />designated newspaper of the municipality. at least ten days prior to the <br />hearing.
