Comprehensive plan <br />Gem Lake; Minnesota. <br />12.1.5 The following criteria for decisions should be included: in the zoning <br />ordinance <br />A. For Rezoning (zone district map Athendment): <br />The proposed zoningshall'lfe consistent with the Comprehensive <br />Land Use.Plan adopted by. the. City if existing. Amendments to <br />#Ile zone district map should be recommended for approval.only <br />upon the IYnding by -the planning Commission that all of Ehe. <br />following conditions exist; <br />I. A mistake has been made in. the original zoning which was <br />inconsistent with the comprehensive or Land Use Plan which <br />should now be cozrected along with the zoning; or substantial <br />changes have occurred. in tbe.*commumty since the -adoption <br />of the comprehensive or'Lihd Use plan, which should t`esult <br />in the plan(s) and the zoning being amended. <br />2. There shall exist a clear public need for a benefit from <br />additional:zoning of the type proposed which. shall be above <br />-andbeyond any benefit:or.eonvenience to the Iand owners. <br />3. 'Beyond apublic need being evident., there shall be a showing <br />-that the Public interest would be best served by -rezoning the <br />Property.in questioia -rather. am other properly in the <br />community. <br />4..In the case -of down zoning, which is *the changing. of a zone <br />district from a higher or more int+ nsive use. to #1;lower.or less <br />intensive use, the proposed zoning Shall allow the <br />owner a reasonable use of his ro P3! <br />p perty under the-ternns of this <br />ordinance, as well as serve the publidIntere.st. <br />B. For Variances: A; variance may be granted only upon finding all <br />Of the following: <br />1, The proposed use is reasonable. <br />2; It would be unreasonable to ieq <br />ordinance. uire conforming to the <br />.3. The difficulty of conforming * to the ordinance is due to <br />Circumstances unique to the property. <br />4.
