HIGH FENCE REQUESTS: CONDITIONAL USE PERMIT FOR AN 8' HIGH FENCE 1 FENCE SETBACK VARIANCE APPLICANT: ❑AN MEYSEMBOURG LOCATION: 4144 ;SCH EUN EMAN ROAD ZONING: IRS — MEDIUM DENSITY RESIDENTIAL PUBLIC. HEARING: REQUIRED Mr. Meysembourg is requesting City approval of a Conditional Use Permit which would allow him to construct an 8' high wire fence to help keep deer and other wildlife out of his gardens. Mr, Meysembourg is raising organic corps for distribution to.several customers. The Meysembourg property is located at the corner of Scheuneman Road, the rail line and Hoffman Road. The property is zoned .RS requiring a minimum lot size of ,75 acre, for a non-sewered property. The Meysembourg property is .44 acres in size, Section 16.1.3 of the Consolidated Land Use Ordinance regulates fencing. The following general provisions are from the ordinance: 16.1.11 General Prvvis.ions:. A. No fences shall be placed on or extend into a public or private right=of--way or utility: easement. B, The side of the fence considered the "face" (i.e.. the side having no structural supports). shall face abutting property or the public or private right-of-way. C. Both sides of the fence shall be maintained in a condition of reasonable repair and appearance by its owner and shall not be allowed to become or remain in a condition of disrepair or danger or constitute a nuisance, public or private. D. No physical damage of any kind shall occur to abutting property during fence construction, E.
