HIGH FENCE <br />REQUESTS: <br />CONDITIONAL USE PERMIT FOR AN 8' HIGH FENCE 1 FENCE <br />SETBACK VARIANCE <br />APPLICANT: <br />❑AN MEYSEMBOURG <br />LOCATION: <br />4144 ;SCH EUN EMAN ROAD <br />ZONING: <br />IRS — MEDIUM DENSITY RESIDENTIAL <br />PUBLIC. <br />HEARING: <br />REQUIRED <br />Mr. Meysembourg is requesting City approval of a Conditional Use Permit which would <br />allow him to construct an 8' high wire fence to help keep deer and other wildlife out of his <br />gardens. Mr, Meysembourg is raising organic corps for distribution to.several customers. <br />The Meysembourg property is located at the corner of Scheuneman Road, the rail line <br />and Hoffman Road. The property is zoned .RS requiring a minimum lot size of ,75 acre, <br />for a non-sewered property. The Meysembourg property is .44 acres in size, <br />Section 16.1.3 of the Consolidated Land Use Ordinance regulates fencing. The following <br />general provisions are from the ordinance: <br />16.1.11 General Prvvis.ions:. <br />A. No fences shall be placed on or extend into a public or private right=of--way or utility: <br />easement. <br />B, The side of the fence considered the "face" (i.e.. the side having no structural <br />supports). shall face abutting property or the public or private right-of-way. <br />C. Both sides of the fence shall be maintained in a condition of reasonable repair and <br />appearance by its owner and shall not be allowed to become or remain in a <br />condition of disrepair or danger or constitute a nuisance, public or private. <br />D. No physical damage of any kind shall occur to abutting property during fence <br />construction, <br />E. All fences shall be constructed inside the property lines of a lot, If corner property <br />stakes cannot be readily identified, a certificate of survey and setting of corner <br />property stakes is necessary before fence. construction starts. <br />F. All man-made fences shall consist of materials comparable in grade and quality to <br />the following: decorative masonry, wrought iron or wood, provided the surfaces are <br />
