MINUTES OF MEETING ❑F CITY COUNCIL OF CITY OF GEM LAKE The July meeting of the City Council of the City of Gem Lake was. called to order on Monday, 18 July 1994, at 7:03 p..m, in the first floor meeting room of Tousley Ford. Mayor Emeott, Councilmembers: Igo, McPhil- lips and Birkebak, Clerk Magnuson, and Planning Commission Chairman David Gardner were present.. Also present were Mr. John Birkeland and. Mr. David Godfrey. The minutes of the 20 June 1994 City Council Meeting were,: upon motion duly made and seconded, unanimously approved as presented. The Clerk then noted that Mr. R.M. Hansen and Mr. Vince Johnson had request- ed copies of the official minutes and that same would be forwarded. Copies, of Variance. No_ .9401 and 9402 were then presented and are. attached hereto as Exhibit "A" and Exhibit "B". Mr. Gardner was then recognized.. Copies ofletters: sent to Birke- land, Johnson, Hansen and Oswald were theft presented and are attached hereto as. Exhibits "C" ■ 110" , and :' E" . Mt. Gardner reported that corre- spondence has been received .from the City of St. Paul regarding fill being placed in the Hoffman Road areas being discussed. Although reports have been received from Mr. Ray Waschin, the trucking company delivering the fill, they are vague as to the total amount of fill that has been deli.ver.ed. As of 13 April 1.994, estimates show thefollowing quantities of fill per property owner: Oswald 14,000 yards Hansen 2.00 yards Birkeland 3,000 yards Johnson........... 300 yards Additionally, .test results of the fill have been provided t.o Mr. Gardner which indicate no contamination. Mr. Gardner then asked the Council for the earliest date it could meet jointly with the Planning Commission to bring the matter to conclusion. Included in Mr. Gardner's report wasa recommendation that the parties indemnify the City against all action that may result from contamination of fill and the filling process. itself. After discussion, it was determined that the city Council would. meet jointly on C8 August 1994 with. the Planning Commission and then. convene the city Council meeting immediately thereafter_. The Clerk was advised to publish a Public Notice to that effect. The 3..0. Jure 1994 I-35E Corridor Study report, a copy of which is. attached hereto as Exhibit "F" was then discussed with noaction taken. Correspondence dated 05 July 1994 and attached hereto.. as Exhibit "G" regarding a Major Comprehensive Plan Amendment adopted by Vadnais Heights and relative to Bikeway/Trails Plan was then presented and discussed with no action taken. Regarding the matter of the continuing violations of the city's Sigh Ordinance by the furniture store at Hoffman Road and County Road "E", Mr. Gardner advised that he is discussing the Matter with both Mr. Newsome and Mr, Meslow to determine the appropriate civil action to be taken. Discussion of the proposed change in zoning in Vadnais Heights to allow the. Fontana Development/Target Store project followed with no action taken.
