MINUTES OF MEETING ❑F CITY COUNCIL <br />OF CITY OF GEM LAKE <br />The July meeting of the City Council of the City of Gem Lake was. <br />called to order on Monday, 18 July 1994, at 7:03 p..m, in the first floor <br />meeting room of Tousley Ford. Mayor Emeott, Councilmembers: Igo, McPhil- <br />lips and Birkebak, Clerk Magnuson, and Planning Commission Chairman <br />David Gardner were present.. Also present were Mr. John Birkeland and. Mr. <br />David Godfrey. <br />The minutes of the 20 June 1994 City Council Meeting were,: upon <br />motion duly made and seconded, unanimously approved as presented. The <br />Clerk then noted that Mr. R.M. Hansen and Mr. Vince Johnson had request- <br />ed copies of the official minutes and that same would be forwarded. <br />Copies, of Variance. No_ .9401 and 9402 were then presented and are. <br />attached hereto as Exhibit "A" and Exhibit "B". <br />Mr. Gardner was then recognized.. Copies ofletters: sent to Birke- <br />land, Johnson, Hansen and Oswald were theft presented and are attached <br />hereto as. Exhibits "C" ■ 110" , and :' E" . Mt. Gardner reported that corre- <br />spondence has been received .from the City of St. Paul regarding fill <br />being placed in the Hoffman Road areas being discussed. Although reports <br />have been received from Mr. Ray Waschin, the trucking company delivering <br />the fill, they are vague as to the total amount of fill that has been <br />deli.ver.ed. As of 13 April 1.994, estimates show thefollowing quantities <br />of fill per property owner: <br />Oswald 14,000 yards Hansen 2.00 yards <br />Birkeland 3,000 yards Johnson........... 300 yards <br />Additionally, .test results of the fill have been provided t.o Mr. Gardner <br />which indicate no contamination. Mr. Gardner then asked the Council for <br />the earliest date it could meet jointly with the Planning Commission to <br />bring the matter to conclusion. Included in Mr. Gardner's report wasa <br />recommendation that the parties indemnify the City against all action <br />that may result from contamination of fill and the filling process. <br />itself. After discussion, it was determined that the city Council would. <br />meet jointly on C8 August 1994 with. the Planning Commission and then. <br />convene the city Council meeting immediately thereafter_. The Clerk was <br />advised to publish a Public Notice to that effect. <br />The 3..0. Jure 1994 I-35E Corridor Study report, a copy of which is. <br />attached hereto as Exhibit "F" was then discussed with noaction taken. <br />Correspondence dated 05 July 1994 and attached hereto.. as Exhibit <br />"G" regarding a Major Comprehensive Plan Amendment adopted by Vadnais <br />Heights and relative to Bikeway/Trails Plan was then presented and <br />discussed with no action taken. <br />Regarding the matter of the continuing violations of the city's <br />Sigh Ordinance by the furniture store at Hoffman Road and County Road <br />"E", Mr. Gardner advised that he is discussing the Matter with both Mr. <br />Newsome and Mr, Meslow to determine the appropriate civil action to be <br />taken. <br />Discussion of the proposed change in zoning in Vadnais Heights to <br />allow the. Fontana Development/Target Store project followed with no <br />action taken. <br />
