For Variances: A variance may be granted only upon finding all of <br />the following: <br />• The proposed use is reasonable. <br />• It would be unreasonable to require conforming to the ordinance. <br />• The difficulty of conforming to the ordinance is due to <br />circumstances unique to the property. <br />• The problem must be one not created by the landowner. <br />• The variance, if granted, will not alter the essential character of <br />the locality. <br />For Conditional Uses: <br />• The use conforms to the Land Use or Comprehensive Plan of the <br />City. <br />• The use is compatible with the existing neighborhood. <br />• The use will not impede the normal and orderly development <br />and improvement in the surrounding area of uses permitted by <br />right in the zone district. <br />• The location and character of the proposed use is considered to <br />be consistent with a desirable pattern of development for the <br />area. <br />•� Develop more specific criteria to protect the water body of Gem <br />Lake. This could include setback requirements, impact zones <br />and vegetation removal regulations. <br />12.2 Other Ordinances <br />Other ordinances can also be created or updated to meet the needs <br />of the community. <br />• Landscaping requirements for individual properties (especially <br />commercial properties) and for the boundaries of the City should <br />;\ be developed to maintain the aesthetic quality of Gem Lake. <br />YThese regulations should include requirements and criteria for a <br />site plan. <br />• Tree preservation regulations should also be created and <br />strengthened. <br />• The sign ordinance should be examined to determine its <br />effectiveness.
