Citizens interested in .interpretations of the <br />provisions. of `.the Comprehensive Municipal Plan, or revisions to it;. <br />are -encouraged to meet with the Plarod ig Commission -at .its <br />regularly Kheduled sessions. <br />1.5 Compliance with the.Plan <br />The Comprehensive Plan of Gem Lake is designed to be more than <br />a mere document spelling out general municipal. policies. It is. <br />principally intended as a decision -making aid. primarily for. (a) <br />.guiding the expenditure of public -cap ital funds and (b) establishing <br />the underlying rationale. for the development codes and ordinances. <br />which more specifically control private development within the City. <br />In particular, the Comprehensive Plan is the -_guiding document of <br />zoning. <br />Minnesota State Statute 462.356 (Subdivision 2) further spells out <br />required compliance with theplan where i bli capital;investments <br />are .involved: <br />NAAec a Comprehensive Municipal Plan or Section thereof has. <br />been recommended.. by the Planning Agency (the Gem Lake <br />Planning Commission) and a copy filed with the governing body <br />(the. Gem Lake City Council), .no publicly owned interest in real <br />Property within the Intinicipalityshall be acquired or disposed <br />of, nor shall any capital improvement be authorized by the <br />municipality or special district or agency thereof or any other <br />.political subdivision having jurisdiction within the municipality <br />until after: the Planning Agency (City Planning Commission) has <br />reviewed the proposed acquisition, disposal, or capital <br />impxoyements and reported in writing to the governing body <br />(City Council) or other special district or agency or political <br />.subdivision concerned,. its findings: as to compliance of -the <br />proposed acquisition,. disposal or improvement with the <br />Comprehensive Municipal Plan. Failureof the Planning Agency <br />to -report on the.proposal within 45 flays after such a reference, <br />or such other period as may b..designated by the governing <br />body (City Council), shall be deemed to have satisfied the <br />requirements of this subdivision. The governing body (City <br />Council) may, by * resolution adopted by two-thirds vote, <br />dispense with the requirements* of this subdivision when in its <br />judgmept:.it finds that theproposed acquisition or disposal of real <br />property or capital improvement has- no relationship to the <br />Comprehensive Municipal Plan." <br />1.6 Amendments to the Plan <br />The Comprehensive Municipal: Planof the . City of Gem Lake is <br />designed to be amendable. The:City Planning Commission has the <br />authority granted by the City Council to annually review the <br />contents -of the Comprehensive: Plan and to recommend any potential <br />Comprehensive Plan A-GEMLK- 501.00 <br />Gem Lake, Minnesota Page 3 <br />
