IN. Changes to the Area of Potential Effects (APE). <br />A. In accordance with 36 CFR § 840.4(a)(l) and in consultation with.MnSHPO and <br />other Consulting Parties; FTA has defined and documented an APE for the Project <br />(Attachment B). <br />B. Throughout the Project design process,. and as needed during Project construction,. <br />FTA, with the assistance of the Metropolitan Council's Preservation Lead, shall <br />determine if revisions to the APE are necessary. <br />1. If FTA determines the APE.requires revision, it:shall submit the draft and final. <br />APE, along with any an <br />documentation, to MnSHPO and other <br />Consulting Parties. for review and comment pursuant to Stipulation III. FTA's <br />determination on the revised APE shalt be final. <br />ii. Revisions to the APE do not require a formal amendment to this MOA. If revised <br />and documented by FTA. pursuant to Subparagraph B.i of this Stipulation, then <br />the revised APE shall replace those found in Attachment. A, distributed to all <br />Consulting Parties, filed with the ACHP, and used throughout the remainder of <br />the Project unless further revisi <br />modifications. ons to the APE are necessary due to Project <br />C. If any new, previously urisurueyed, areas are added to the APE, the procedures in <br />Stipulation X shall be followed to identify historic p <br />the Project roperties that may be affected by <br />X. Additional Survey and Evaluation <br />A: When necessary,. FTA and the Metropolitan Council in consultation with. MnSHPO <br />and other Consulting Parties shall conduct surveys. and evaluation of properties in the <br />APE la account for any areas added to the APE through revisions made under <br />Stipulation IX, the receipt of additional information about known or suspected <br />historic properties in the APE, and when necessary due to delays in. Project <br />construction, as described in Subparagraph. A.ii of this :Stipulation. <br />i. The survey and evaluation shall be performed by SOI-Qualified Professionals <br />appropriate to the resource. types) being identified and evaluated and shall meet <br />the requirements of Stipulation II:A. <br />H.
