James CUP Staff Report: November 2, 2021 <br />Gem Lake Planning Commission Page 3 <br />Landscaping would be required, as per Section 26 of the ordinance. Since the lot would have Jess than <br />1.00 stalls; one landscaping island -would be required in the lot: At least one tree would be required, per <br />Section 26.3:2, A 20 foot. landscaped yard is required..between a parking -lot and the right=of=way (ROW); <br />this is also required for as part of the Gateway -- NC zoning district. The current plans:. do not confirm the. <br />setback from the ROW. <br />ILIP Criteria <br />Interim Use Permits are. covered in section 17:5 of the ordinance.. The section includes information .to <br />review, as well as .criteria to consider when approving or denying. a: request. <br />Section 17.5.2(A) notes that 'Impact on the following criteria shall be reviewed and measured by.the <br />Planning Commission and City Council: <br />1) Adjacent Uses <br />2) Air and Water Quality <br />3) Traffic. Generations <br />4) Public Safety and Health. <br />5) Area Aesthetics <br />6) Economic Impact on the Entire Area <br />7) .consistency with the Comprehensive Municipal Plan, and <br />8) Antic.ip.ated Duration of the Conditional or.Interim Use." <br />Section 17.5.9 lists the standards that would apply to .conditional and interim uses: <br />A) Existing Uses. Shall be in accordance with zoning and building standards in effect at. the time of initial <br />construction and development:and shall continue to be governed.b.y such regulations in the future. <br />B) New Uses, Small conform as follows: <br />1.) .Compliance with all: zoning and other regulations as may otherwise be applicable; <br />2) The date or the event that will terminate the use can be identified with certainty; <br />3) The existence of the Conditional or Interim Use will not impose additional costs on the public if <br />It becomes necessary for the public to take the property in the future; <br />4) The user agrees to any conditions of approval.as.sociated with. the. approval of the Conditional <br />or Interim. Use Permit by the City Council. <br />C) .Existing and New Uses. Shall conform as. follows: <br />1.) Shalt maintain harmony and compatibility with surrounding uses and with the architectural <br />character and design.stand ards of existing uses and development; <br />2) Shall meet or exceed all Performance Standards contain elsewhere in.this Ordinance; <br />3) Shall not generate such additional traffic associated with the use that would overburden or <br />exceed the capabilities of streets and other.public services.and.facilities including, but not .limited <br />to, parks, schools, and utilities.serving the area. <br />Findings <br />Below is the criteria from Section 17.5.2(A) in italics, with the Planner's findings following.: <br />1) Adjacent Uses <br />The uses directly to the. north and south are residential homes. Screening would be able to reduce issues <br />with views and noise between the proposed parking and the house .to.the. south, though the house to the <br />north. would have its parking connected, to the parking lot based on. the proposed plans, Other properties <br />7 <br />
