the manner in which the City is desires to develop. It covers the <br />unique assets, liabilities, and key development issues facing the <br />City in the coming years. Citizens interested in interpretations of <br />the provisions of the Comprehensive Plan, or revisions to it, are <br />encouraged to meet with the Planning Commission at its regularly <br />scheduled sessions. <br />Compliance with the Plan <br />The Comprehensive Plan of Gem Lake is designed to be more than <br />a mere document spelling out general City policies. It is intended <br />as a decisio making aid for (a) guiding the expenditure of public <br />capital funds, and (b) establishing the underlying rationale for the <br />development of codes and ordinances, which more specifically <br />control private development within the City. In particular, the <br />Comprehensive Plan is the guiding document of zoning. <br />Minnesota State Statute 462.356 (Subdivision 2) further spells out <br />required compliance with the plan where public capital investments <br />are involved: <br />"After a Comprehensive Municipal Plan or Section thereof has <br />been recommended by the Planning Agency (the Gem Lake <br />Planning Commission) and a copy filed with the governing body <br />(the Gem Lake City Council), no publicly owned interest in real <br />property within the municipality shall be acquired or disposed of, <br />nor shall any capital improvement be authorized by the <br />municipality or special district or agency thereof or any other <br />political subdivision having jurisdiction within the municipality <br />until after the Planning Agency (City Planning Commission) has <br />reviewed the proposed acquisition, disposal, or capital <br />improvements and reported in writing to the governing body (City <br />Council) or other special district or agency or political subdivision <br />concerned, its findings as to compliance of the proposed <br />acquisition, disposal or improvement with the Comprehensive <br />Municipal Plan. Failure of the Planning Agency to report on the <br />proposal within 45 days after such a reference, or such other <br />period as may be designated by the governing body (City Council), <br />shall be deemed to have satisfied the requirements of this <br />subdivision. The governing body (City Council) may, by resolution <br />adopted by two-thirds vote, dispense with the requirements of this <br />subdivision when in its judgment it finds that the proposed <br />acquisition or disposal of real property or capital improvement has <br />no relationship to the Comprehensive Municipal Plan. " <br />Amendments to the Plan <br />The Comprehensive Plan of the City of Gem Lake is designed to <br />be amended as the City grows and changes. The City Council <br />provides authority to the Planning Commission to conduct an <br />City of Gem Lake Comprehensive Plan page 2_ <br />
