detail in what respects the Developer has failed to complete the Improvements in accordance with the provisions of the Agreement, or is otherwise in default, and: what. measures or acts will be. necessary, in the. opinion of the City, for the Developer to tale or perform in order to obtain such certification. (c) The City will take ownership of the improvements when the last lot is sodded and the City has signed.off on all public infrastructure. ARTICLE IV The Developer will construct and install, at Developer's expense, the. following.improvements identified under Parts.A and B C Developer's.Improvemen& }, according to the terms and, conditions stated herein. Develo er's Improvements art A Section 4J.. Site Grading. The Developer shall do all site grading associated. with common greenway, trails/sidewalks and open spaces, storm water storage ponds and surface drainage ways including sodding of boulevards, all in accordance with the Construction Plans. Upon completion of all grading, Developer's engineer shall certify in writing that the site is graded to the approved. plans and that 0 unbuildable soils are removed from within the street right-of-way and within the buildable area identified herein. Also, :the Developer agrees prior to commencement of grading to call a pre -construction meeting between the City, Developer and contractors for the site grading. Section.4.2. Soil Erosion and Tree _Protection.. The Developer shall control soil erosion. ensuring - (a) All development shall conform. to the natural limitations presented by the topography and soil of the subdivision in order to create the best. potential for preventing soil erosion. The Developer shall submit an erosion control plan as part of the grading and drainage plan, detailing all'erosion control measures to be implemented during construction. Said plan shall be approved by the City prior %to the commencement of site grading or construction. The developer shall also submit a. copy of their Storm Water Pollution Prevention Plan (SVVPPP) to the City prior to commencement of site grading or construction, (h) Erosion and siltation control measures shall be coordinated with the different stages of development, Appropriate control measures, as .required by the City, shall be installed prior to development when necessaryto control erosion; (c) Land shall be developed in increments of workable size such that adequate erosion and siltation controls can be :provided as construction progresses. The smallest practical area. of land shall be exposed at any one period of time. (d) Where the topsoil is removed, sufficient comparable soil shall be set aside for re -spreading over the developed area which shall also be seeded, mulched, and disk anchored, 7
