detail in what respects the Developer has failed to complete the Improvements in <br />accordance with the provisions of the Agreement, or is otherwise in default, and: what. <br />measures or acts will be. necessary, in the. opinion of the City, for the Developer to tale or <br />perform in order to obtain such certification. <br />(c) The City will take ownership of the improvements when the last lot is <br />sodded and the City has signed.off on all public infrastructure. <br />ARTICLE IV <br />The Developer will construct and install, at Developer's expense, the. following.improvements <br />identified under Parts.A and B C Developer's.Improvemen& }, according to the terms and, conditions <br />stated herein. <br />Develo er's Improvements art A <br />Section 4J.. Site Grading. The Developer shall do all site grading associated. with <br />common greenway, trails/sidewalks and open spaces, storm water storage ponds and surface drainage <br />ways including sodding of boulevards, all in accordance with the Construction Plans. Upon <br />completion of all grading, Developer's engineer shall certify in writing that the site is graded to the <br />approved. plans and that 0 unbuildable soils are removed from within the street right-of-way and <br />within the buildable area identified herein. Also, :the Developer agrees prior to commencement of <br />grading to call a pre -construction meeting between the City, Developer and contractors for the site <br />grading. <br />Section.4.2. Soil Erosion and Tree _Protection.. The Developer shall control soil erosion. <br />ensuring - <br />(a) All development shall conform. to the natural limitations presented by the <br />topography and soil of the subdivision in order to create the best. potential for preventing soil <br />erosion. The Developer shall submit an erosion control plan as part of the grading and <br />drainage plan, detailing all'erosion control measures to be implemented during construction. <br />Said plan shall be approved by the City prior %to the commencement of site grading or <br />construction. The developer shall also submit a. copy of their Storm Water Pollution <br />Prevention Plan (SVVPPP) to the City prior to commencement of site grading or construction, <br />(h) Erosion and siltation control measures shall be coordinated with the different <br />stages of development, Appropriate control measures, as .required by the City, shall be <br />installed prior to development when necessaryto control erosion; <br />(c) Land shall be developed in increments of workable size such that adequate <br />erosion and siltation controls can be :provided as construction progresses. The smallest <br />practical area. of land shall be exposed at any one period of time. <br />(d) Where the topsoil is removed, sufficient comparable soil shall be set aside for <br />re -spreading over the developed area which shall also be seeded, mulched, and disk anchored, <br />7 <br />
