The topsoil shrill be restored to a depth ofat least,four (4) inches and shall be of a quality at <br />least equal to the soil quality prior to development. <br />(e) The Developer shall be responsible to maintain the required tree protection <br />during all grading activities and any planting of trees will comply with the conditional use <br />permit; preliminary plat, and the tree consultant's input. <br />Section 4.3. Iron Monument Placement. The Developer shall place iron monuments at all <br />lot and Block corners and.at all. other angle points on boundary lines. Iron.monurnents shall be placed <br />after all streeettutilities (public and private) and lawn grading has been completed in order to preserve <br />the lot markers for future. property owners.. <br />Section<4.4. Street -Signs. The Developer shall pay for the installation of all standard street <br />signs at :all locations required for the. development as determined by the City. Engineer. The City <br />Engineer shall, by, advise Developer of the required sign locations. The Developer has the option of <br />installing the signs per City design and installation requirenierits or the City shall install all sail? <br />signage and. the Developer shall reimburse the City for the cost thereof by payment in advance to the <br />City of the estimated cost thereof. <br />Seetion.4.5. Street and Stomi SewerMaintenpgg. The Developer shall. be responsible for <br />street and storm sewer maintenance, including curbs, boulevards, sod, street sweeping and.. storm <br />sewer cleaning until 144%a of the homes within the development are constructed upon the lots. The <br />City's Consulting Engineering Will conduct site visits to ensure compliance; Staff will contact the <br />Developer in writing and give a reasonable timeframe to meet compliance. Ifthis is not met, the City <br />will sweep the streets and. invoice the Developer for time spent. Warning signs shall be placed when <br />hazards develop in streets to prevent the public. from traveling on same and directing attention to <br />detours. If and when the street becomes impassable, such streets shall be barricaded and closed. In <br />the event residences are occupied prior to completing streets, the developer shall maintain a smooth <br />driving surface and adequate drainage on all temporary streets. Performance shall be guaranteed by <br />the financial guarantee recited.herein.. <br />Section 4.6. Storm Water Holding Ponds and Infiltration Basin, - The Developer shall <br />dedicate and survey all storm water holding ponds and infiltration basins as required by the City. The <br />DoYcloper shall be responsible for storm sewer cleaning. and holding pond dredging; as reasonably <br />required by the City, prior to completion and acceptance of the development. The Developer grants. <br />the City the right to enter upon the property to perform all functions. required under this Agreement <br />and City Codes,. Performance shall be guaranteed by the Performmee Guarantee set`forth under`this <br />Agreement. <br />Wetlands. The Developer and Home Owners Association shall be responsible <br />for creation. and maintenance of wetlands for the life of the wetlands. The Developer shall prepare <br />and provide copies of all wetland monitoring .reports and maintenance activity records per the <br />requirements of the Watershed District, to. the City Engineer for. review;. <br />Section 417. At�provals and Permits, The Developer shall be responsible for securing all <br />necessary approvals and permits fror all appropriate Federal, State, Regional and Local jurisdictions <br />prior to. the commencement of site grading and prior to the construction of Developer Improvements. <br />NZ <br />
