J,
TAB.
Memorandum
Ta: Gem Lake City Council.
Copies To: Patrick Kelly, City Attorney
From: Evan Monson, Planner
Date: January 13, 2022
SUBJECT: Home Occupations
MEETING DATE: January 18, 2022
BACKGROUND
Reference: Home Occupations
Project No.
Routing:
. 18398.000
The city has been looking into. ways to improve the requirements and regulating of home occupations.
Home occupations can vary in scope and definition from place to.. place, but typically they are considered
a use or activity carried out. in a residence by the. occupant. Such use or activity not change the
character of the residence and is often defined asbeing incidental, ancillary, or secondary to th& primary
use, .which in this case would be residential.
The goal of updating these requirements and regulations is to provide -something that is clear, concise,
and makes sense for the community. Given the shifting nature of work during the COVID-19 pandemic;
many people are able to utilize their Internet connections at home to compfete the jobs they previously did
fn an office. It would be counter -intuitive to. designate such an activity like that as prohibited, nor would it
make .sense to require a permitting processfor such an activity. The purpose of having requirements
would be to avoid. having `intensive' or `nuisance=creating' activities. from taking place on a residential
property, as such uses would be better served in commercial or industrial zoning districts where such
activity is expected: and permitted to take place, and to distinguish. what is and is not to be permitted. This
process has also given the city an opportunity to further decide if uses should be permitted by -right (not
needing a permit), or if a.ficense or permitting process of some kind is applicable,
The following page and attachments include information on the: draft ordinance for the council to consider
for.adoption..The Planning Commission has been working on this project for sometime. A rough draft
was reviewed and discussed at the December Planning Commission meeting. The rough draft used the
existing .definition and ordinance (ordinance. #85) as a starting point, with some changes made
throughout.
The City Council has the ability to make further changes, if needed. if a consensus is reached, the
Council may take up a vote to adopt. the ordinance.
TKDAO 1.444 Cedar Street Suite 1500 1 Saint Paul, MN 55101
651.292.4400 • tkdaxom
An employee -owned company promoting affirmative action and equal opportunity.
