3. Detachment and Annexation of Property from the City of Vadnais Heights, The <br />westerly most portion of the property, approximately 3,160 square feet. in area is <br />located in Vadnais Heights. <br />4. A. Cond itiona I Use Permit to allow the requested site improvements and uses. <br />.5. Minor Subdivision. Hy-Vee is proposing to detach the northerly most 25' of their <br />property and dedicate it to Ramsey.County for additional public right-of-way. The <br />dedicated right-of-way is provided to accommodate a sidewalk, boulevard and a <br />future turn lane. <br />Consolidated Land Use Ordinance Amendment — This amendment is necessary to <br />add the uses 'proposed by Hy-Vee to the list of uses permitted andlor conditionally <br />permitted in the Gateway Zoning. District, Retail and Commercial. Uses are. permitted by <br />section 9.6,5 of the Consolidated (Nand Use Ordinance. Several retail and commercial <br />uses are listed as being permitted or conditionally permitted. The Hy-Vee proposal <br />requests a convenience store With fuel islands, a restaurant, liquor stare, and coffee shop.. <br />None of the uses are spedfidally identified as being permitted in the City. Staff <br />recommends adding these uses to the list if the City wants to approve the Hy-Vee <br />proposal. <br />Hy-Vee would like the. City to amend Section 9.10.5 A-•2 of the. Consolidated Land use <br />Ordinance to allow less glass on the p0maryentry side of the. building. A minimum of 60°/0: <br />glass is required...Hy-Vee proposes 35% glass on the northwest facing, primary entry side <br />of the building. <br />Vacation of Public Right -of -Way — Hy-Vee would like the City to. vacate 11,985 square <br />feet. of the current Hoffman Road right-of-way which would allow the. use of the area for. <br />development. Hy-Vee is planning the drive-thru stacking. lane within this area which is <br />currently right-of-way. The Hoffman Road right-of-way is the jurisdiction of Gem Lake {this. <br />is being verified with Mn©OT and Ramsey County}. The width of the right-of-way is <br />approximately 9V. <br />After review by the City.. it. is recommended that. the City consider providing a License <br />Agreement to Hy -flee in order to use a portion of the .Hoffman Road right-of-way for a <br />drive-thru lane, stormwater treatment, utilities and landscaping. The license Agreement <br />would be in lieu of vacating the Hoffman Road right-of-way. <br />The Agreement would allow Hy-Vee: to develop a portion of the right-of-way. The license <br />Agreement may be subject to a fee imposed. by the. City. <br />Any approval of a License Agreement should be subject to Hy-Vee and any subsequent <br />property owner being responsible for construction and maintenance of the driveway <br />
