A portion of the right-of-way is <br />proposed to be vacated or in the alternative, requests the City's approval of a <br />License Agreement. which would permit Hy-Vee's use of the property to <br />accommodate the drive lane and stormwater treatment ponding <br />■ A screened exterior trash enclosure is proposed <br />■ A bike rack with concrete pad and sidewalk connecting to the County` Road E <br />sidewalk is proposed <br />■ A monument sign is. shown along County Road.E <br />In order to approve the proposed Fast & Fresh Store, the following approvals are required <br />from the City: <br />Consolidated Land Use: Ordinance Amendment. The amendment to the ordinance <br />would add the .requested uses to the list of uses permitted in the Gateway Zone. <br />1.13. Amend Section 9.19,5 A-2 of the Consolidated Land Use Ordinance which requires <br />the primary entry side of commercial buildings to have a minimum of 60% of the <br />15; floor fagade that.faces a public street shall be windows or doors of clear lightly- <br />,� tinted glass. <br />Hy-Vee is proposing. 35% glass windows and doors. The ordinance can be <br />amended to change the 60%. requirement to 35%. <br />2. Vacation of Public Right -of -Way. Hy Vee is requesting the City to vacate a strip of <br />right-of-way.along Hoffman Road between the southernmost portion of the site up <br />to County Road E. The area of the requested. vacation is 11,985 square feet and <br />is. 17' wide expanding to 72..04' wide. at. the County Road E right-of-way. After <br />review by the City, it is. recommended that the City consider providing. a License <br />Agreement to Hy-Vee in order to use a portion of the Hoffman Road right-of-way <br />for a. drive-thru lane, stormwater treatment, utilities, and landscaping. The License <br />Agreement would be in lieu of Hy Vee's request to vacate a portion of the Hoffman <br />.Road right-of-way.. <br />9 <br />
