MEMORANDUM <br />TO'. PLANNING COMMISSION <br />FROM: TOM RIEDESEL <br />DATE: JUNE 25, 20181 REVISED SEPTEMBER 26, 2018 <br />SUBJECT: GARAGE CONSTRUCTION <br />REQUEST: SPECIAL USE PERMIT TO CONSTRUCT AN OVERSIZED <br />ACCESSORY STRUCTURE <br />5' HEIGHT VARIANCE <br />LOCATION: 3 HILLARY FARM LANE <br />APPLICANTS: STEVE & NATALIE ROWAN. <br />The Rowan's are requesting approval of a Conditional Use Permit which, if <br />approved; would allow construction of a 999 square foot (27' x 37) ba.rn to be used <br />for vehicle storage and horses in the future. A lean-to is also shown on the north <br />and east sides of the building. <br />The Rowan's home with an attached garage is located on Lot 26, Hilary Farm. In <br />addition,. there is an existing barn which was part of: the Bemis Estate on Lot 25. <br />The Rowan's own both Lots 25 and 26. The new detached accessory structure is <br />proposed to be located on Let 25 which is approximately 300' north of the Rowan <br />home. The. proposed accessory structure and existing barn are.located on Lot 25. <br />Access to the existing barn and proposed. accessary structure are via an easement <br />which is located over both Lot 26 and the. Smith lot at 5 Hilary Farm Lane. <br />The proposed height of the building is approximately 20' as measured from grade <br />to the tip of the. roof. The maximum. height permitted for an accessory structure in <br />the Hillary Farm development is 15'. A variance must be approved for the new <br />building to exceed. 15' in height; In the alternative, the City could amend the <br />accessoryheight requirements by increasing the height permitted from 1.5' to: 20' <br />or 25' as permitted in the RE district. Note: The RX, RS and RO Zoning Districts <br />limit the height of an accessory structure to 15% <br />Hillary Farm is. located in the RX - Executive Residential Zoning District. <br />Agricultural structures are permitted by Conditional. Use Permit.in the RX Zone. <br />Section. 6.3.3 of the Consolidated Land. Use Ordinance lists requirements for the <br />agricultural. structures. They include: <br />➢ The structure; if planned to house animals shall be set back 100' from. any <br />lot line. <br />The structure is located at least 100' from all lot lines. <br />A The structure shall be at least 100' fron <br />dwelling. <br />The structure is proposed tQ be <br />systems and neighboring homes. <br />Drainage characteristics in the land shall <br />concentration of animal waste. <br />any well, ISTS or neighboring <br />at leash 10.0' from wells, septic <br />not cause a nuisance due to the <br />
