➢ The accessory barn shall be designed and constructed to be consistent with <br />the main dwelling on the {property: <br />➢ Other factors deemed material .by the. City. <br />Section 17.5 of the Consolidated Land Use Ordinance sets the standards which <br />must be considered when reviewing a Conditional or Special Use Permit. They <br />include consideration of the following: <br />1 } Adjacent. Uses <br />2) Air and Water Quality <br />3) Traffic: Generation <br />4} Public Safety and Health <br />5} Area Aesthetics <br />fi} Economic Impact on the Entire. Area <br />7} Consistency with the Comprehensive Municipal Plan <br />S} Anticipated Duration of the Conditional or Interim. Use: <br />In addition. to. meeting the requirements of the City Ordinance, the use must be <br />permitted by the Hillary Farms Homeowners Associa tion... It is staffs understanding <br />that accessory structures larger than 1,000 square feet in area must be approved <br />by the. association. The. Rowan's have. been working with the HOA to..approve their <br />requested accessorybuilding. Documentation has been provided by the HCA <br />approving the structure. <br />A Special Use Permit is required to allow the structure as there. is currently an <br />attached garage and barn on the property. The area of both of these structures <br />combined exceed 1,000 square feet. <br />A height variance must also be approved in order to allow the structure to exceed <br />15' in height or the ordinance must be amended allowing an accessory Structure <br />taller than 15'. Specifically, Section 4.5(2) of Ordinance No. 43G and 43G.4.7 of <br />Ordinance No. 131 could be amended, <br />The following may be considered: <br />4.5 (2) No accessory building shall exceed the .height of the. principal <br />building. However, in no case, shall such accessory building exceed <br />trverity{2'} feet in height. <br />If the building as proposed meets the standards for approval of a.
