SECTION 25:- SIJBDIWSIQN <br />Section25.1 Purpose <br />25:1 In order to safeguard die.best: interests of the City of Gera Lake and to. assist the subdividerin hannonizi'g his <br />interests with those of the City .at large, the following section is :adopted so that the adherence tothe same will bring <br />results: beneficial. to both parties:.It is the purpose of this section to remake certain. regulations and requirements for the <br />platting of land within the City: of Gem Lake, pursuant tothe authority contained -in Minnesota Statutes, which <br />regulations. the .City, Council deems necessary for the. health, safety and general welfare of this community. <br />Section 25.2. Jurisdiction <br />25.11 The. regulations hereian.govcr ing plats and the subdivision of lurid shall apply within the corporate limits of the <br />City of Gerd Lake, MN. <br />Section. 25.3 Interpretation <br />25.3.1. The interprctation and.applicatian.nf the provisions.of this section.shall be min;mllm xequixements <br />adopted for the.protection of public health, safety and general welfare.. <br />Section.25.4 Requirements <br />25.4.1. The form of the contribution,: cash or land (or any combination), shall. be: as <br />determined by.the City. Council in an amount equal to ten (.10.09/6) percent .of.the total acreage in the development or <br />ten: (10.0°/6) percent of the:pre-development land value. <br />25.5.2. Subdivision of land which has been previously platted and officially recorded and which contains less than one <br />(1) acre shall be exempt :from. dedication requirements.. <br />25:5:3. Land to be dedicated .for parks, playgrounds and public open spaces shall be reasonably'suitable for its intended. <br />use and shall be at a location convenient to the. people to be served. Factors used in evaluating the adequacy of <br />:proposed.park:and recreation.areas shall:include size,.. shape, topography, geology, hydrology; tree cover, access and <br />location. The. City Council, at its discretion; may rejectproffered land. and. mandate manetary contribution. <br />' 25.5.4The Gem Lake Planning: Commission shall review all park land dedication proposals including the..location of <br />land and the amount. of land to be: conveyed or dedicated within a proposed development or subdivision.
