MEMORANDUM <br />TO: PLANNING COMMISSION <br />FROM: TOM RIEDESEL <br />DATE: JANUARY 21, 2010 REVISED MARCH 15, 2010 <br />SUBJECT: RELOCATION OF AUTO SALES BUSINESS <br />REQUESTS: MODIFICATION OF 4 SEASONS AUTO C.U.P.; <br />C.U.P. FOR FOUR SEASONS AUTO SALES TO ALLOW <br />OUTDOOR DISPLAY AND SALES <br />APPLICANTS: DENNIS NEWCOMB — D/B/A — FOUR SEASONS AUTO <br />SALES <br />LOCATION: 1995 E COUNTY ROAD E <br />PROPERTY <br />OWNER: AL DRUMMOND <br />ZONING: NEIGHBORHOOD COMMERCIAL <br />The Gem Lake City Council recently approved a Conditional Use Permit for Four <br />Seasons Auto Service and Sales which permits auto sales and repair at 3622 <br />Scheuneman Road. The applicants for the Conditional Use Permit were Rick <br />Wilson, who operates the auto repair portion of the business and Dennis <br />Newcomb, who operates the auto sales portion of the business. <br />The Council approved the Conditional Use Permit for a period of 12 months with <br />follow-up by the City at the time of permit expiration. The Permit was approved <br />on 9/15/09, and is subject to the following requirements: <br />• No autos shall be displayed for sale on the street <br />• The Permit is non-transferrable; <br />• There shall be no complaints during the 12 month period; <br />• 20 auto maximum for sale on the property; <br />• One auto per parking space; <br />• Business hours 6 a.m. — 10 p.m. — Monday — Saturday; and <br />• Auto drop off shall occur on the side of the building and not on street. <br />Mr. Newcomb has submitted a Conditional Use Permit application which <br />requests City approval to relocate the auto sales portion of the business to the <br />southwest corner of Mr. Drummond's building. This portion of the building faces <br />County Road E, and has a County Road E address. <br />With the relocation of the sales office, the outdoor display area is also requested <br />to be modified, Mr. Newcomb originally proposed to display up to 10 vehicles in <br />front of the building. He has modified his proposal and now requests displaying of <br />6 vehicles in front of the building. Two are proposed to be parked on the south <br />side of the building (County Road E side) and 4 on the west side (Scheuneman <br />
