III. CONSTRUCTION <br />The CITY and TOWNSHIP shall be responsible for the construction <br />of the Municipal Building. The selection of the general contractor <br />shall be performed in accordance with Minnesota Statute Section <br />471.345, the Uniform Municipal Contracting Law. <br />IV. OPERATING COSTS, EXPENSES, AND INSURANCE <br />a. Operating Expense and Maintenance: The TOWNSHIP and <br />the CITY each anticipate using the building for their <br />government operations. The parties shall share the burdens <br />of operating, maintaining, and repairing the building, with <br />such shares to be determined by mutual agreement. The <br />parties agree to consult one another regarding potential <br />tenants of the Premises, and on any proposed expansions or <br />alterations desired by either party. Approval for a proposed <br />tenant, expansion, or alteration shall not be unreasonably <br />withheld. <br />b. Liability: At all times, the parties shall keep in full force and <br />effect a policy or policies of liability insurance with respect to <br />the premises described in this agreement, with companies <br />licensed to do business in the State of Minnesota. Each <br />party shall name the other party as an additional named <br />insured and shall provide adequate coverage under <br />reasonable limits of liability of not less than the statutory <br />3 <br />
