MINUTES OF MEETING OF CITY COUNCIL <br />OF CITY OF GEM LAKE <br />The. June meeting Of the City Council of the City of Gen Lake was <br />calledto order on Monday,: 20 June 1994, at 7:00 p.m. in the first floor <br />meeting roOml Of Tousley Ford. Mayor Emeott, Councilmember:s Nielsen., Igo, <br />McPhillips and.Birkebak, Clerk Magnuson, Treasurer Nordstrom, Planning <br />Commission Cha ff[uan David Gardner, and Zoning Administrator Jim Arend <br />were present.. Also present were Joseph Franz, Lloyd Nielsen, Deb Oswald, <br />Ray Taschin, Vince Johnson, Peter Oswald, Rob Hansen, and Dick Hansen. <br />The minutes of the 16 May 1994 City Council Meeting were, upon, <br />motion duly made and seconded, unanimously approved with amendments <br />indicating Counci1member McPhillips and Nielsen as present. <br />Mr. Gardner was then recognized. Minutes of the 31 May 1994 and 13 <br />June 1994 meetings of the Gem Lake Planning Commission, attached hereto <br />as Exhibits "A" and "B" were presented for discussion and action as <br />follows: <br />1. At the recommendation of the Planning Commission and upon <br />motion duly Made {McPhillips.} and seconded {Birkebak}, a SF.ecial. <br />Use Permit was unanimously approved for construction of a twenty- <br />four (24' f foot x thirty-two (32 `) foot .addition to the garage of <br />Mr. & Mrs. Joseph Franz providing said addition is in accordance <br />with the bu.il.ding code and with the condition that they maintain..a <br />natural landscape screen on the west side of the building and Use <br />the building for storag.e:.only. A copy of said Special Use Permit is <br />attached hereto as Exhibit "Cu. Also included in the motion ap- <br />proved was a Variance allowing six -hundred sixty-four (664 sf) <br />square feet over the tine -thousand (1,:(70.0 sf) allowed. A copy of the <br />Variance i.s attached hereto as Exhibit "D". <br />2. At the recommendation of. the Planning Commission and upon. <br />motion duly made {McPhillips} and seconded {Birkebak}, a Variance <br />was unanimously granted to Mr. & Mrs. Ronald Docken, said variance <br />providing a six (6 0") foot variance to nine (9.' 0") feet from the <br />Zoning Ordinance side yard setback requirement of fifteen (15'0") <br />feet for :construction of a south facing attached garage. A copy of <br />said Variance is attached hereto as Exhibit <br />3. Discussion then followed regarding filling activity at 3516 <br />North Highway 61, 3524 Hoffman Road, 3538.Hoffman Road, and 3542 <br />Hoffman Road. At therequest of Mayor Emeo:tt., Mr. Arend had inves- <br />tigated the filling activity at:all addresses. Regarding the prop-- <br />erty at 3516. North. Highway 61 owned by Peter and Deb Oswald, a <br />Filling Permit was approved 17 May 1993 for this property, said <br />Permit having expired on 17 May 1994.It was: then noted that fill- <br />ing at the three Hoffman Road properties was initiated in the fall <br />of 1993 without firstobtaining. permits. Mr. McPhillips asked the <br />parties involved what the source of this significant amount of fill <br />was.. Mr. Ray Taschin responded that itwas being delivered froth a <br />f.ed.era:lly funded sewer renovation project near Grand and St. Clair <br />Avenues in St... Paul. In as much as the materials are beingtaken <br />from an urban site involving potential ground contamination from <br />sewer systems, Mx'. McPhillips further:asked if any soil boring and <br />testing have been completed on the fill insuring that contaminated <br />fill is not being dumped in the City of Gem Lake where ground water <br />contamination could pose a serious problem.
