MINUTES OF MEETING OF CITY COUNCIL OF CITY OF GEM LAKE The. June meeting Of the City Council of the City of Gen Lake was calledto order on Monday,: 20 June 1994, at 7:00 p.m. in the first floor meeting roOml Of Tousley Ford. Mayor Emeott, Councilmember:s Nielsen., Igo, McPhillips and.Birkebak, Clerk Magnuson, Treasurer Nordstrom, Planning Commission Cha ff[uan David Gardner, and Zoning Administrator Jim Arend were present.. Also present were Joseph Franz, Lloyd Nielsen, Deb Oswald, Ray Taschin, Vince Johnson, Peter Oswald, Rob Hansen, and Dick Hansen. The minutes of the 16 May 1994 City Council Meeting were, upon, motion duly made and seconded, unanimously approved with amendments indicating Counci1member McPhillips and Nielsen as present. Mr. Gardner was then recognized. Minutes of the 31 May 1994 and 13 June 1994 meetings of the Gem Lake Planning Commission, attached hereto as Exhibits "A" and "B" were presented for discussion and action as follows: 1. At the recommendation of the Planning Commission and upon motion duly Made {McPhillips.} and seconded {Birkebak}, a SF.ecial. Use Permit was unanimously approved for construction of a twenty- four (24' f foot x thirty-two (32 `) foot .addition to the garage of Mr. & Mrs. Joseph Franz providing said addition is in accordance with the bu.il.ding code and with the condition that they maintain..a natural landscape screen on the west side of the building and Use the building for storag.e:.only. A copy of said Special Use Permit is attached hereto as Exhibit "Cu. Also included in the motion ap- proved was a Variance allowing six -hundred sixty-four (664 sf) square feet over the tine -thousand (1,:(70.0 sf) allowed. A copy of the Variance i.s attached hereto as Exhibit "D". 2. At the recommendation of. the Planning Commission and upon. motion duly made {McPhillips} and seconded {Birkebak}, a Variance was unanimously granted to Mr. & Mrs. Ronald Docken, said variance providing a six (6 0") foot variance to nine (9.' 0") feet from the Zoning Ordinance side yard setback requirement of fifteen (15'0") feet for :construction of a south facing attached garage. A copy of said Variance is attached hereto as Exhibit 3. Discussion then followed regarding filling activity at 3516 North Highway 61, 3524 Hoffman Road, 3538.Hoffman Road, and 3542 Hoffman Road. At therequest of Mayor Emeo:tt., Mr. Arend had inves- tigated the filling activity at:all addresses. Regarding the prop-- erty at 3516. North. Highway 61 owned by Peter and Deb Oswald, a Filling Permit was approved 17 May 1993 for this property, said Permit having expired on 17 May 1994.It was: then noted that fill- ing at the three Hoffman Road properties was initiated in the fall of 1993 without firstobtaining. permits. Mr. McPhillips asked the parties involved what the source of this significant amount of fill was.. Mr. Ray Taschin responded that itwas being delivered froth a f.ed.era:lly funded sewer renovation project near Grand and St. Clair Avenues in St... Paul. In as much as the materials are beingtaken from an urban site involving potential ground contamination from sewer systems, Mx'. McPhillips further:asked if any soil boring and testing have been completed on the fill insuring that contaminated fill is not being dumped in the City of Gem Lake where ground water contamination could pose a serious problem.
