aware of any tests that had been performed. It was stated by one of <br />the parties that Mr. Noble; Gem. Lake's former Zoning. Administrator <br />had given verbal authorization for some filling, although no writ- <br />ten record or knowledge:of said authorization was presented. Based <br />upon the fact that the Oswald Filling Permit has expired; that no <br />permits were applied for or issued, and that no information on the <br />content of the fill has been presented, and upon motion duly Made <br />{McPhillips} and seconded {Birkebak}, the Council voted unanimously <br />to order all filling terminated until such a time as the` following <br />are delivered to the Gem Lake Planning Commission: a) Correspon- <br />dence from the legal jurisdiction(s) (eg city, town, etc.). from <br />which the Materials used for filling were taken stating contents of <br />the materials and listing any and all potential contaminants tothe <br />satisfaction of the Gem. Lake Planning Commission and City Council, <br />and; b) Correspondence from the contractor who removed the materi- <br />als used for filling from the point(s) of origin stating the oxi-- <br />gin (s) of the : materials , naming the Carrier(S) who removed said <br />material's from the point (s} of origin, stating that only materials <br />identified in a) above were delivered by the carrier (s) , and Stat- <br />ing the quantity of materials removed from each of the paint(s) of <br />origin, and; c) Correspondence from the carrier stating the date of <br />first delivery to your site and the total quantity of materials <br />delivered toyour site from each of the point(s) of origin of said <br />materials. Upon receipt by the Planning Commission, said documents <br />will be: reviewed and Applications For Filling Permits reviewed, <br />includingpossible penalties for work performed without permits. <br />Copies of letters sent to the parties are attached hereto as Exhib- <br />its " F "G" and „g n <br />D. Discussion then followed regarding the proposed Fontana Devel- <br />opment in Vadnais Heights which includes a Target Store as anchor <br />tenant. The position of the Planning Commission is stated clearly <br />in minutes attached. After discussion and upon mo.t.ion duly made <br />€Mc:Ph ]lips.} and seconded 4Birkebak},. Resolution No. 94fl.8, a copy <br />of which is attached hereto with supporting information as Exhibit <br />"I" was unanimously adopted.. <br />E. Additionally, Vadnais. Heights development along County Road <br />"E" and the I-35E Corridor Study were discussed with no action <br />taken. <br />Mr. McPhillips suggested that we contact neighboring cities and <br />obtain copies of their long range community plans for review as each of <br />the communities actions seem to affect Gem Lake. <br />The. Recycling Report for May was then presented, a copy of which is <br />attached hereto as Exhibit "J" <br />Discussion then followed regarding. the Smart Cart use: and replace- <br />ment of Traffic: Officer. Labathe by Office Ken Splitsoss.er.. A copy of the <br />19 May 1994 Minutes and 16 June 1994 agenda for the contract cities <br />group are attached hereto as Exhibit "K" <br />The Clerk then reported: that fire inspections should be started and <br />that no reports have yet beet filed. <br />
