Member Nielsen. to approve:Resolution No. 2000-09 <br />granting approval of the finial plat for Hunters .Run of Gem Lake as prepared by Metro Land Suiveiiig &Engineering (the <br />`Plat") with the condition that no building permits shall be issued for any work wit hinthe Plat beyond prelimiitaty grading until <br />each of the following conditions ame`met: <br />CONDITIONS: <br />llmt Outlot 1 and Outlot Hof the Plat.(andthat portion ofthe roadway branch which is owned by the City. ofGem .Lake <br />extending easterly off Outlot l of the Plat)Vshalf be conveyed to a rion-profit corporation known. as South Roadowners <br />Association of Gem Lake, Inc. (the"Association") whose potential members shall in all owners of -real property <br />with easement rights over Outlot I of the. Plat and all owners of real property abutting all .or any portion.0 Oudot I or <br />Outlot H of the.Plat:or the roadway branch extending. westerly offOntlot k1 or the roadway- branch extending easterly <br />off Oudat I of the Plat who choose .to become-members.of the Association.pursuant.to a Road Use and Maintenance <br />Agreement in form and substance satisfactory to and approved. by the..City Attorney and Whioh shall be:filed of record. <br />with the 'County Recorder of Ramsey County, Minnesota. <br />2. That. Outlot A. of the Plat shall be .conveyed to a non-profit corporatioti known as Hunters Run of Gem .Lake <br />Homeowners Association,.. Inc, pursuant .to.a, Declaration of Covenants, Conditions and Restrictions in form and <br />substance satisfactory to and approved by. the City :Attorney whose members shall include the owners of Lots 1, 2 and <br />3.of the Plat and which shall be :filed for record with the County Recorder of Ramsey County, Minnesota. <br />3. That Outlots B, Ci D, E, F and G. ofthe Platshall be conveyed to. the owners. of the real .properties, .respectively, adjacent <br />thereto for combination as single tax parcels only with said respective adjacent real properties and with evidence:ofsuch <br />conveyance and'tax parcel combination being provided to -the satisfaction.of the City Attorney. <br />a. Before Lots. 1-5, Block 1, of the.Plat are -.sold by. the D"Ioper,. a Deve.loper's Agreeinent .between the. Developer aiid <br />the City in form and substance satisfactory tQ and approved l}y the City Attorney shall be executed and tiled of record <br />with the County Recorder of Ramsey County, Minnesota; to address the foregoing.conditions and such other conditions <br />as are customarily contained therein including the following conditions: <br />(a) All grading and ponding sliall be completed pursuant to'the City.approved Oi2ding.Plan prepared by Metro <br />Land Surveying:& Engineering. <br />(b). Trees shall be cut and removed only:pursuant to the City approved Tree Inventory.prepared by Metro Land <br />Surveying & Engineering. <br />(c) The private drives.on Outlot A.and the roadway branch extending westerly offOutlot H.ofthe Plat shall be <br />improved consistent with the requirements and time table set:by the City Engineer and to theCity's satisfaction. <br />;Notwithstanding the.foregoing, the Deve.loper.shall not be required�to pave beyond thirty (30') feet north of <br />the -north line of Lot 5 of the Me, <br />(d) All utilities-atidthe Iike-aballbe installed underground. <br />(e) All dead trees identified in the June 5, 2000-report from the City forester -shall lie removed. <br />(f) All lot corn6m, angle and. curve points on tho.outside:boundary lines of the Plat shall be stalled, flagged and <br />appropriately marked by iron monuments. <br />(g) Five (5.) spruce. trees at leastfour (4.')feet in height: shall be plantedatlocations acceptable to -the Kirchoffs: <br />.5.
