CM(OF OEM LAKE <br />RESOLUTION NO.200.4-12 <br />21-June 2004 <br />RESOLUTION OF THE CITY OF GEM LAKE, MINNE90TA <br />CONSOLIDATING CERTAIN IMPROVEMENT PRO.IECTS <br />WHEREAS,the City of Gem lake.(the "City") previously instituted proceedings for the following public improvements:. <br />(a) Pursuant to. Resolution No. 2004-05 adopted by the .City .Council (the "City Council"j of the City on May 2.4, 2604 (the. <br />"Resolution 200.4-05"), the City ordered sanitary sewer improvements (the "Original 2604 Improvements") for homes <br />abutting.Sch.eunetnan Road 'leading up to a single. family residential development to be. constructed by .McNulty <br />Construction (tlie "Development")and in the Developmettr, and <br />(b) Pursuant to Resolution*.Nq. 2004-I l adopted bythe-Cfty Council o -the date hereof(('Resolution*20.044 1"); the City <br />.9rdered. sanitary sewer improvements for homes. al �gtting.'Scheuneman Road commencing.at the.intersection With Li?ahl <br />Circle and thence northerly approaunately 1.000 feet .to- the intersection of .Scheunemon -and .Otter Lake Roads <br />(the "Additional 2004 Improvements").; and <br />WHER EAS,the City Council held an improvement hearing for the Original.20.04 lmprovetnents on May 24, 2004 priorto adopting <br />Resolution 2Q04,Q51hat ordered the irtiprovements described as the Original 2004 Improvements; and <br />WHEREAS,the City Council held an .improvement hearing for the Additional: 2004 Improvements on the date hereof prior to <br />adopting Resolutiop 2004-11 that.ordered the improvements described as the Additional 2004 lmprovements and <br />WHEREAS,th(rCity .Council lias:'detennined that the various components of the Original 2004 ttitprovetnents and the Additional <br />2004 Improvemetwinay be more economically completed if consolidated and joined as one project, as authorized under Minnesota <br />Statutes, Section*435:56, as amended: Now. Therefore Be it <br />RESOLVE F) hat the Cite Counci[:of the City of Gem Lake acknowledges and orders. as follows: <br />l: The Council hereby consolidates and joins -the Original 2004.1 rrtproyements and the: Additional2Q04 Improvements as. a <br />single consolidated project for all:purposes under Minnesota Statutes, Section 435.56, �as amended; and Chapter 429, as <br />amended. <br />2. All proceedings in connection with each component of the Original 2004 improvements and the Additional 2004 <br />Improvements shalfbe deemed instituted and conducted.as.one proceeding. <br />3.
