CITY OF GEM.LAKE" RESOLUTION NO.2004-I3 14 July*2004- RESOLUTION OF THE CITY. OV GEM .LAKE, MINNESOTA. AMENDING ORDINANCE NO. 64 AND ORDERINd THig ENACTMENT OF SAID AMENDMENTS. WHERFAS,the-City of:Gem Lake. (the "City") previously instituted proceedings for the f`ollo ing.public improvements: (a) Pursuant to Resolution No. 2004-05 adopted by the Ciry Council (the '`City Council") of the City on May 24, 2004 (the "Resolution 2004-05"). the City ordered sanitary sewer improvements (ilie. "Original 2004 Improvements") for homes: abutting..Scheuneniaii Road leading up to a single family residential development to .be constructed by McNulty Construction.(the "Development") and in -the Development; and N Pursuant to Resolution No. 2004-11 adopted by the City Council on the:date:liereol'("Resolution 20()4-I 1"), the City ordered satiitttry sewer.improvementsfor homes abutting Scheuneman.Road commencingat the intersection with Kahl Circle and thence. northerly approximately 1.000 :feet to the- intersection of Scheunemati and Otter Lake Roads (the "Additi4Rial 2904 (niprovements") and. W H E R EAS,the City Council held. an improvement heai`ing. fozrthe Original 20041itl0mvemeitts on May 24, 2004 prior to adopting Resolution 2004-65 that. ordered the improvements described as the fJrigina12004•1niprovertienw and ViWI4.EsREAS,the City .Council held an improvetnent.hetfinig for the; Additional 2004 Impr6venients-:on4he date. hereof prior to adopting Resolution 2004-E 1 that ordered tite improvements descrited astlie Additiona12004 Improvements; and WHEREAS,the City Council has determined that the various coMponents bf the:Original 2004improvements. and the Additional 2004 ltiiptovenients.niay.be`tiiore*economically completed if consolidated and joined as one project, as authorized. under Minnesota Statutes, Section 435.56;.as amended; and WHEREAS no written Public litiprovenient.Policy has-been adopted b..y.the City and the addition and amendment orcertain terms in 0tdinance No. 64 would p,mvide-a more equitable allocation of costs ofthe. project to. the beneftted property owners; and W1415REAS a properly noticed'Public Hearing has..been held on.the matter and the results:o(saidliearing have been duIyconsidered �tilong with a Stittement.ofNeed and Findings ofl=aet.Now, .Therefore Be It.
