CITY OF GEM LADE <br />RESOLUTION NO.2004-17 <br />.07 *September 2004 <br />A Resolution ppposinga petitiotrbeing.cotisidered`by theCity Council ofthe Cit of Vadnais Heights by Bryan. <br />M. Hansen for concurrent detachment of real property currently located in the Cityof(rem Lake And annexation <br />to the City of Vadnais Heights. <br />WHEREAS. Bryan Nl, Hansen is.the (.apparent) fee title owner of 17.64 acres of -real property identified as Ramsey .County <br />Property Identification Number 27.-30-22-34-0007 located in the City of Gem Lake; Ramsey County, Minnesota; and <br />WHEREAS, Bryan M.. Hansen did on 14 July2004 petition the City'of Vadnais Heights to consider.-coitcurrent detachment of <br />said lands fron.the. City of Gem Lake and Annexation to the..City: of Vadnais Heights; and. <br />WNEREAS, resolutions) .have been prepared by tlie. City Attorney of the City of Vadnais Heights for consideration of said <br />concurrent ddachntent. and.annexation based upon what we believe to be incomplete and erroneous facts; NOW THEREFORE <br />BE IT <br />RESOLVED, that the City Council of the Cityof Gem Lake urges the City Council .of (lie City of Vadnais.Heighis to deny the <br />petition of Bryan-M. Hansen for concurrent detachment and annexation of real property located in theCity of Gem I;ake and <br />identified as Rainsey..County Property. I dent ificaiion Number 27-30-22-34-0.007.based upon, butnot limited to, the followingficts <br />of record with the City of Gem Lake: <br />I ) on:24 May 1974 regarding.a petition forconcurrenudetachmgnt.and annexation to Vadnais..H:eiglitsflled by the Hansen <br />family for this.sante parcel, an -ORDER of.the Municipal Commission the -State of Minnesota executed by Howard. <br />L. Kaibel, Executive Secretary, was. issued and. -is on file with the City -of Gem Lake and states: as follows: "iT IS* <br />ORDERED that the petition for detachment. may'bg; and :hereby is, in all aspects denied."; and <br />2) in 1.981 and. based upon the.speeirc written request of Mr.: Bryan. M. Hansen on :file. with. the City of Gem Lake, the. <br />Planning Commission and City Council of the City. of Gem Lake amended the. Gem .Lake Zoning Ordinance and the <br />attendant zoning for this property to meet the needs of Mr. Hansen's proposal at the time it was presented and using <br />language and. potential uses that were provided :by Mr. Hansen for said amendments; and <br />3) in the: twenty-three. (23) years since expending substantial effort on Hansen's behalf to facilitate his development <br />of the property in question, no formal applications for consideration have been received from. Mr. Hansen by -the City <br />of Gem Lake except that two uses contrary to Mr. Hansen'g original request andsuppositions were discussed informally <br />and, whiie both uses were considered too intensive for:the property, the*potentiat `clients were invited to.stibmit <br />applications and proposals, how.ever'no submissions have been received; and <br />4) the City of Gem Lake. has the ability, to deliver. the necessary services for development of this property which are, <br />referenced by the Municipal Board in the denial. of Hansen's petition in 1974 and are evidenced by several past and <br />durrent.developments in the City of Gem Lake; and <br />S) contraryto Mr. Hansen's .reference. to Mr. Uttley's undated letter regarding the Gem Lake wastewaterplan,.Mr. Donald <br />S: Blulun, Manager Municipal Services Section; Metropolitan Council. Environmental Services advises�in�vriting on 06 <br />August 2004 and again on'30 August 2004 Iltat the City of Gem Lake Wier 1.1 Sewer Plan was approved by the full <br />Metropolitan Council on 0.9 June 2t)i14 as Item: 2004-174 all of which are on File with theCity ofGem.Lakeand. which <br />states: <br />a) INFRASTRUCTURE: Adequate Capacity has been provided to support the forecasted growth; and <br />b) QUALITY Or LIFE: Plan provides for.redevelopment, and intensification of land uses thatWill help contain. sprawl; <br />and <br />c). COMMUN,ICATION/CONSTiTUENCY BUILDING: The plan has. been submitted to the adjoinjtig.commuhities <br />as part of the planning process and wastewater services are being prov ded:consistent.with their plans; and <br />d) ALIGNMENT: The Tier i1 Comprehensive Sewer Plan is consistent with the Regional .Growth Strategy. <br />6) following attempts by the Gem Lake Planning Commission to.amend the zoning for the. property and based upon. Mr.; <br />nts <br />Hansen's opposition to those amendme,. Mr. Hansen was invited to submit additional information on uses fbrthe <br />property and participatein the development of appropriate revisions tp.the ordinance:which lie has declined to do. <br />F IIRTHER 1tESOLVED, that should the Vadnais Heights CityCoundil followingg revietvofthe aforementioned findings agree <br />W pursue concui•reiitdetachment and annexation Arid inconsideration of the very substantial legal costs that could be involved <br />hithe matter that theCity Council 'of Vadnais Heights require Mr. Bryan M. Hansen.as petitioner to assume full responsi.bi.Iity <br />for all IegaI fees and .fees related to the efforts of both the City of Vadnais Heights and the City of Gem Lake. <br />
