CITY OF GEM LAKE <br />RESOIYUTION NO. 2406-03 <br />17 JANUARY 2006 <br />A 11E8OL1 tko N IN SUPPORT OF DESIGNA.TiNG VADNAIS LAKE <br />AREA WATER MANAGEMENT ORGANIZATION* (..VLAWMO) AS A <br />5PIECIA4-TAXING 161STRIC.T UNDER MINNESOTA STATUTES-275,066. <br />WHEREAS, VLAWM"O isa Joint Powers Management Qrganization established. for the General Purpose of 'to (1) <br />protect, preserve and use natural surface. and groundwater storage .and retention systems; arid, (2) minimize capital <br />expend ituresttecessary to.cor.rect flooding and water quality problems; and, (3) identify and.plari for means to.effeOively <br />protect and improve.surface and groundwater quality; and;.(4)establish more uniform local policies and official controls <br />for-surllace and groundwater management; and (5) prevent erosion of soil into:surface water-systeins; and (0) promote - <br />.groundwater recharge; and (7) protect and enhance fish and wildlife habitat-attif water*recreational facilities-aridsecure. <br />other *benefits associated with the proper management of surface and groundwater.; and <br />WHEREAS, members cif the.JointPowers Water Management Organization currently support VL.AWM0- thfoug4 <br />general fund budgets or utility fee budgets; and <br />WHEREAS, VLAWMO members have found this funding method to be inequitable with. residents outside of <br />VLAWMO jurisdiction paying.fortwo watershed budgets; and <br />WHEREAS. the ability to levy for planning and implementation of Water Plans and Projects is provided to Water <br />Ylanagement Organizations (WMO) under in Statute Section 1 311241; and <br />WHEREAS,. VLA WMO has been advised that.designation as a Special Taxing District under Minnesota Statute $ectton <br />2.75:066 is required to allow this Water MattagetnentOrganizationto.levya tax, with the precedent ofMiddle Mississippi <br />WMO. now, therefore, be it <br />RESOLVED, that the Pity Cotmcil of the City of Gent Lake:§upports the inclusion of the Vadnais Lake Area Water <br />Management Organization under Minnesota Statutes Section275,066 as. a.
