VLAWMO Meeting — February 9, 2006 They agreed to extend the eastern edge of the mitigation to add more mitigation. Restore the base of the retaining wall, working within a 3 — 4 foot range of the wall for the restoration. Mark Burch would like to examine the drainage plan. Jim Johnston moved, with Mark Burch seconding the approval of the Comfort Meadows Wetland Replacement plan as submitted with the following conditions: ♦ The wetland mitigation area would be increased along its SE corner. This would move the southern border of the existing wetland further south on the north side of the eastern office building. It will eliminate the 90 degree corner and produce a more natural looking contour. ♦ Submission of documentation required to proceed with an Impact rectification process on all wetland areas proposed to be bounded by retaining walls. o Photos of the temporary impact area prior to disturbance should be identified or submitted. o A bond or cash surety to cover the cost of restoring 10 feet into the wetland for all wetland areas adjacent to retaining walls must be submitted. This surety will be held until VLAWMO is satisfied that the wetland has been adequately restored or it will be used to complete restoration. Opportunities for vegetation enhancement shall be utilized. The applicant must indicate they understand restoration must be done within six months of disturbance. ♦ The bond or cash surety to cover 125% of the cost of the creating and managing the mitigation, to be held up to 5 years, must be submitted to VLAWMO. ♦ Deed recording utilizing the forms available on the BWSR website must be filed with the County with copies sent to VLAWMO. All aye, with Mark Bigelbach abstaining. Motion passed. Levy Authority - Joel Schilling Joel Schilling reviewed Supplemental letter agreement. He has provided the effort in a staged approach, with the front end including the most effort. April 5t' is the legislative deadline. Hearings may involve more time. Mark Burch asked if this could be done other ways, such as volunteers from cities pursuing the lobbying effort? Paul Emeott noted that we will lose the work and momentum and what we have spent so far if we don't proceed. Mark Burch wanted the budgetary source of paying for Joel's services to be identified. Mark Bigelbach recommended we check on securing community funds from Vadnais Heights for $1000. Several option were considered. The rest of the funding was directed to come from the maintenance budget for this year. Jim Johnston moved, with Steve Haselmann seconding to proceed with the pursuit of levy authority and contract with Joel Schilling for phase one of his agreement letter. Vote: all aye. Motion passed. Responses from the JPA members to our request to offer written support for a legislative action designating us as a Special Taxing District have started to come in. With the exception of the verbal, conditional support of North Oaks, they appear to be in support. Water Plan. The first workshop has been held and the summary was available in the Board packet.
