SIGN -ROOF
<br />A sign erected upon a roof or parapet of a building.
<br />SIGN -SHOPPING CENTER
<br />A business sign which identifies a group of stores, shops or offices that number three (3) or more.
<br />SIGN -TEMPORARY
<br />A sign that is not solidly affixed to a building, structure or land that announces an event such as a bazaar, garage/rummage and estate sale
<br />and/or a sporting or special event of duration of not greater that ninety (90) days out ofa twelve (12) month calendar period. Promotional
<br />and franchise -type banners and pennants, which advertise products or services sold on the site, are also defined as temporary signs.
<br />SIGN -WALL
<br />A sign attached to or erected against the wall of a building with the exposed face of the sign is in a plane parallel to the plane of said wall.
<br />STORY
<br />That portion ofa building included between the surface of any floor and the surface of the floor next above it; or if there is no floor above,
<br />the space between the floor and the ceiling next above. A basement shall be counted as a story.
<br />STREET
<br />A public or private right-of-way not less than forty (40) feet in width which affords a primary means of access to abutting property.
<br />STRUCTURE
<br />Anything constructed or erected, the use of which requires a location on the ground, or attached to something having a location on the
<br />ground, including, but without limiting the generality of the foregoing, advertising signs, billboards, or fences.
<br />STRUCTURE, NON -CONFORMING
<br />Any structure which is legally existing upon the effective date of this Ordinance, which would not conform to the applicable regulations
<br />if the structure were to be erected under the provisions of this Ordinance.
<br />STRUCTURAL ALTERATION
<br />Any change, other than incidental repairs, which would prolong the life of the supporting members of a building, such as bearing walls,
<br />columns, beams, girders or foundations.
<br />TOWER OR ANTENNA SUPPORT STRUCTURE
<br />Any mast, pole spire, lattice structure or similar structure including any lines, cables, wires or braces support ing the structure intended
<br />primarily for the purpose of mounting an antenna, meteorological device or similar apparatus above grade. Towers may be ground or roof
<br />mounted The term "tower" includes any antenna attached to the tower.
<br />USE.
<br />The purpose or activity for which the land, structure, or building thereon is designed, am,nged, or intended, or for which it is occupied
<br />or maintained and shall include the performance of such activity as defined by the performance standards of this Ordinance, Uses shall
<br />be classified as principal or accessory and as permitted, special, interim and prohibited.
<br />USE -INTERIM.
<br />A temporary use of real property requiring a permit issued by the City which shall be allowed until a particular date, until the occurrence
<br />of a particular event, or until zoning regulations no longer allow for said temporary use.
<br />USE, NON -CONFORMING
<br />A use of land, buildings or structures lawfirlly existing at the time of adoption of this Ordinance which does not comply with all the
<br />regulations of this Ordinance or any use of land, building or structure lawfirlly existing prior to the adoption of an amendment which
<br />would not comply with all of the regulations.
<br />USE, PERMITTED
<br />A use which may be lawfully established in a particular district or districts, provided it conforms with all requirements, regulations, and
<br />performance standards of such district.
<br />USE, PRINCIPAL
<br />The main use of land or buildings as distinguished from subordinate or accessory uses.
<br />USE -SPECIAL.
<br />Either a public or private use as listed which, because of it's unique characteristics, cannot be properly classified as a permitted use in
<br />a particular district. This includesthose occupations, vocations, skills, arts, businesses, professions, oruses specifically designated in each
<br />zoning district, which for the respective conduct or performance in such designated districts may require reasonable, but special, unusual,
<br />or extraordinary limitations peculiar to the use for the protection, promotion, and preservation of the general public welfare, health, and
<br />safety as well as the integrity of the City's Comprehensive Municipal Plan. Consideration of each case of special use shall be given to
<br />impact of such use on neighboring real property and of the public need for the particular use at the particular location.
<br />VARIANCE.
<br />A relaxation of the terms of this Ordinance such that deviation will not be coptrary to the public interest and where, owing to physical
<br />conditions unique to the individual real property under consideration and not the results of actions of the owner, a literal enforcement of
<br />this Ordinance would result in an undue hardship.
<br />VEHICLE -MOTOR VEHICLE
<br />Any self-propelled vehicle not operated exclusively upon railroad tracks and any vehicle propelled or drawn by a self-propelled vehicle,
<br />but excepting snowmobiles and mobile homes.
<br />VEHICLE -JUNKED MOTOR VEHICLE
<br />Any motor vehicle which is either abandoned, wrecked, partially dismantled or legally inoperative, or which is not currently licensed for
<br />operation within the State of Minnesota.
<br />VEHICLE -COMMERCIAL VEHICLE
<br />A motor vehicle exceeding one and one-half ton or uluivalcnt in load capacity or a motor vehicle not displaying passenger car or RV
<br />license plates.
<br />WETLANDS
<br />An area where water stands near, at or above the soil surface during a significant portion of most years, saturating the soil and supporting
<br />a predominantly aquatic form of vegetation, and which may have the following characteristics;
<br />i) Vegetation belonging to the marsh (emergent aquatic), bog, fen, sedge meadow, shrub land, and northern lowland forest
<br />(conifer swamp) communities. (These communities correspond roughly to Wetland types 1,2,3,4,6,7, and 8 described by
<br />the United States Fish and Wildlife Service, Circular 39, "Wetlands of the U.S.").
<br />ii) Mineral soils with grey horizons of organic soils belonging to the Histosol order (peat and muck).
<br />iii) Soil which is water logged or covered with water at least three (3) months of the year.
