CITY OF GEM LAKE RESOLUTION NO.2006-11 17 APRIL 2006 A RESOLUTION ESTABLISHING THE CITY OF GEM LAKE PLAN REVIEW COMMISSION AS AN ADVISORY BOARD TO THE CITY COUNCIL AND TO CITY STAFF AND DEFINING IT'S FUNCTION. WHEREAS, it is the policy of the City of Gem Lake to preserve and promote an attractive and stable "small town"residential and commercial environment for it's citizens in accordance with the Comprehensive Municipal Plan as adopted and, from time to time, amended; and WHEREAS, it is the policy of the City of Gem Lake to encourage and to use best management practices to insure high quality residential and commercial development with compatible land uses within the City; and WHEREAS, the City of Gem Lake is required by the Gem Lake ordinances including, but not limited to the Zoning Ordinance as adopted and, from time to time amended, to perform a review of all site plans to insure that all building plans conform with Ordinances enacted and, from time to time amended, by the City and development agreements entered into by the City; now, therefore be it RESOLVED, that in accordance with MN Statutes Chapter 412.111, the City Council of the City of Gem Lake does hereby establish an advisory board to be known as the "Gem Lake Plan Review Commission" with said committee to consist of not more than three (3) members to be appointed by the Mayor and confirmed by a simple majority vote of the City Council, providing, however, that one of said members shall be a duly appointed zoning administrator for the City of Gem Lake; and, be it FURTHER RESOLVED, that the membership of the Commission shall be annually renewed and, as necessary new appointments made, by resolution at the first meeting of the City Council in each calendar year; and, be it FURTHER RESOLVED, that it shall be the function of said commission to: 1) establish criteria for examination of construction plans by the Commission based upon local ordinances, the Comprehensive Municipal Plan and development agreements entered into by the City; and, 2) to review all residential and commercial construction plans requiring building permits to be issued by the City of Gem Lake to insure compliance with the criteria; and, 3) to refer all such J plans to the Certified Building Official appointed by the City of Gem Lake who shall further inspect said plans to insure compliance with all codes adopted by the City of Gem Lake; and, 4) to refer all commercial plans to the City Engineer and other such competent authority as may be necessary for further technical review; and, 5) to make recommendations to administrative staff charged with the issuance of building and building related permits regarding the plan's compliance with all criteria required by the Commission, the Senior Building Official, and the City Engineer; and, be it FURTHER RESOLVED, in the event the Commission recommends denial of a building permit and is unable through negotiation with the applicant to resolve the conflict causing said recommendation for denial then the matter shall be referred to the City Council who shall act as the Board of Appeals in all such matters.
