CITY OF GEM LAKE <br />RESOLUTION NO.2006-12 <br />17 April 2006 <br />A RESOLUTION OF THE CITY OF GEM LAKE, MINNESOTA <br />ODERING CERTAIN PUBLIC IMPROVEMENTS. <br />WHEREAS, the City Council of the City of Gem Lake, Minnesota (the "City") did in April, 2005 commission SEH, INC., acting <br />as City Engineer to conduct a Feasability Report (the "Feasibility Report") indicating the current condition and repair needs of <br />Big Fox Road, Little Fox Lane, Tessier Road and Haven Lane; and <br />WHEREAS, the City did, in October, 2005, expand the scope of the Feasability Report to include consideration of extension of <br />city municipal sanitary sewer and city water to the affected areas with the belief that said considerations were best considered <br />when streets were under construction and were also considered timely in accordance with the City of Gem Lake Comprehensive <br />Municipal Plan; and <br />WHEREAS, the City did review the Feasability Report as presented in March, 2006 and did order public hearings on the matter <br />to be duly noticed, published and convened on 10 April 2006 for Big Fox Road and Little Fox Lane and on 12 April 2006 for <br />Tessier Road and Haven Lane; and <br />WHEREAS, ten (10) days mailed notices and two (2) weeks published notices of the Hearings were given to affected <br />homeowners; and, <br />WHEREAS, the City did convene said public hearings on the dates prescribed, did present the Feasability Reports, did present <br />a reasonable estimate of the impact of the assessment for the Improvement, and did prepare records of the proceedings which are <br />identified as Minutes of Public Hearing No. 2006-01 and Minutes of Public Hearing No. 2006-01 and which indicate acceptance <br />of the Project Engineers findings; and <br />WHEREAS, the (re)construction of the City streets identified as Big Fox Road, Little Fox Lane, Tessier Road and Haven Lane <br />is hereinafter referred to as the "Improvements" and shall also be identified as Public Improvement Project No. 2006-01; and <br />-� WHEREAS, all affected homeowners and persons who desired to be heard with respect to the proposed Improvements were given <br />an opportunity to be heard. <br />J <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEM LAKE AS FOLLOWS: <br />I . The Improvements are necessary, cost-effective and feasible as described in the Feasibility Report prepared by SEH. <br />2. The total estimated cost of the Improvements based upon the Project Engineers estimates for Patch and Overlay with rolled <br />shoulder instead of curbing is as follows: <br />A. Big Fox Road and Little Fox Lane at $106,000; and <br />B. Haven lane at $21,000 plus removal of problematic trees on at approximately $1,000 each or $2,000 total; and <br />3. To order patching and hot oil/rock treatment as necessary and without cost estimate for Tessier Road as part of the project. <br />4. The Improvements are hereby ordered. <br />5. SEH is hereby designated as the engineer for the Improvements. SEH shall prepare plans and specifications for make of the <br />Improvements. Kennedy & Graven, Chartered is hereby designated as special counsel to the City with respect to the <br />Improvements and Ehler's Associates is hereby designated as financial consultant to the City with respect to the Improvements. <br />The foregoing Resolution was offered by Councilor Watson and was supported by Councilor Schilling and was declared <br />udnntod hn.¢ed innn the following vote: <br />NAME <br />EMEOTT <br />WATSON <br />BOSAK SCHILLING <br />RASMUSSEN <br />VOTE <br />Aye <br />Aye <br />Aye Aye <br />Aye <br />Page 4 of 5 <br />
