CITY OF GEM LAKE RESOLUTION NO.2006-20 19 JUNE 2006 A RESOLUTION ADOPTING AMENDMENTS TO ORDINANCE NO. 43G TO PROVIDE LOCAL CONTROLS TO IMPLEMENT THE 1997 COMPREHENSIVE MUNICIPAL PLAN IN ACCORDANCE WITH CITY COUNCIL RESOLUTION NO. 1997-11. WHEREAS, Minnesota Statutes §473.865 requires local governmental units to adopt "official controls" to implement it's Comprehensive Municipal Plan; and WHEREAS, Minnesota Statutes §462.357, Subd. 1 authorizes the adoption of a zoning Ordinance or amendments thereto independent of the foregoing authorization; and W HEREAS, a Zoning Ordinance is an official control within the meaning of Minnesota Statutes §473.852, Subd. 9; and WHEREAS, On 05 June 2006 the Gem Lake Planning Commission held a duly noticed public hearing to review and to receive all public comment, written and verbal, regarding he proposed changes to the City of Gem Lake Zoning Ordinance; and WHEREAS, the City Council adoptedthe 1997 Comprehensive Municipal Plan on 21 July 1997 by means of Resolution No. 1997-11; and WHEREAS, Resolution No. 1997-11 further charged the Gem Lake Planning Commission to recommend amendments to current local controls and to develop of such additional local controls as may be necessary to implement the 1997 Comprehensive Municipal Plan; and WHEREAS, the Gem Lake Planning Commission did on 05 June 2006 vote 3 Aye, 0 Nay, 2 Absent to present the proposed amendments to the Gem Lake City Council for adoption as Ordinance No. 431-1; now, therefore, be it RESOLVED, that the City Council of the City of Gem Lake hereby adopts the following findings of fact: 1) the proposed amendments to the Zoning Ordinance as recommended by the Gem Lake Planning Commission promote the public health, safety, morals, and general welfare and promotes the use of land within the City of Gem Lake to conserve shorelands and otherwise accomplish the purposes authorize by Minnesota Statutes §462.357, Subd. 1; and 2) the proposed amended Zoning Ordinance No. 43H is consistent with the 1997 Comprehensive Municipal Plan. and, be it FURTHER RESOLVED, that based upon the foregoing Findings of Fact and all proceedings and information in the files of the City relating thereto: 1) Zoning Ordinance No. 43H is hereby adopted in it's entirety; and 2) The Zoning District Map shall be updated to reflect all changes contained in Ordinance No. 43H and is hereby adopted as the official Zoning District Map of the City of Gem Lake; and 3) The summary of Ordinance No. 43H attached hereto as Exhibit "A" shall be published in the White Bear Press in lieu of the full text of Ordinance No. 43H.
