CITY OF GEM LAKE RESOLUTION NO. 2006-19 19 JUNE 2006 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR BRUCE AND LORRY SHIRLEY, 1400 GOOSE LAKE ROAD TO ALLOW FOR CONSTRUCTION OF A SINGLE FAMILY HOME WITH A REAR ELEVATION IN EXCESS OF THE HEIGHTS ALLOWED IN SECTION 7.4, ORDINANCE NO. 43G AND SECTION 5.4, (PROPOSED) ORDINANCE NO.43H. WHEREAS, Bruce and Lorry Shirley have made an application for a Conditional Use Permit to provide for an exterior elevation of forty-four (44') feet to provide for construction of an attached garage adequate for parking their motor home in doors; and WHEREAS, the needs for issuance of a Conditional Use Permit have been reviewed by the Zoning Administrators and Plan Review Committee and determined to be valid and in the best interest of the property; and WHEREAS, a duly noticed public hearing on the matter was convened before the Gem Lake Planning Commission on 05 June 2006 in accordance the procedures set forth in Ordinance No. 43G and all in attendance were heard; and WHEREAS, the Gem Lake Planning Commission recommends issuance of the Conditional Use Permit in accordance with Ordinance No. 43G; and WHEREAS, the Plan Review Committee recommends issuance of the Conditional Use Permit in accordance with (Proposed) Ordinance No. 43H; and WHEREAS, the matter of this Conditional Use Permit comes before the City Council of the City of Gem Lake at it's regular meeting convened on 19 June 2006; now, therefore, be it RESOLVED, that the City Council of the City of Gem Lake finds adequate findings for the application and no significant opposition to the application and therefore approves issuance of a Conditional Use Permit providing for construction of a single family home with an exterior facade less than ten (10') greater than the thirty-five (35') feet allowed, providing construction of the building commences within one (1) year from the date first of this issuance.
