CITY OF GEM LAKE <br />MINUTES OF PUBLIC HEARING <br />13 NOVEMBER 2006 <br />A duly noticed public hearing was convened before the Gem Lake City Council on 13 November 2006 at 7:08 pm <br />in the first floor meeting room of Tousley Ford located at 1493 East County Road "E" in the City of Gem Lake for the <br />purpose of receiving public comment on the proposed assessment of costs of work for Public Improvement Project No. <br />2006-01 (PIP2006-01) which includes patching and reconstruction of Big Fox Road, Little Fox Lane and Haven lane <br />as well as patching and seal coating of Tessier Road. <br />Mr. Magnuson presented the final accounting for the project indicating a slight variance from costs identified in the <br />public hearing Costs identified in the public hearing notice were stated to be $241,525.83 with allocations to Big Fox <br />Road and Little Fox Lane of $174,142.33, to Haven Lane of $48,028.67 and to Tessier Road of $19,354.84. Actual final <br />costs for the entire project are $243,440.83 with allocations to Big Fox Road and Little Fox Lane of $175,523.06, to <br />Haven Lane of $48,409.48 and to Tessier Road of $19,508.30. Mr. Magnuson noted that the final notice for the project <br />includes the corrected costs as well as financing information offering City financing at an interest rate of 5.9% over ten <br />(10) years. Mr. Magnuson also advised of provisions for deferment of the assessment as provided for by State Statutes <br />and indicated he has had one request for same. When asked by Dr. Anderson-Uzpen, Magnuson explained that he <br />believed the deferment ran, with interest, until there was a change in fee title on the property at which time said <br />assessment and interest became due and that said assessment took precedence over all other claims against the property. <br />Mr. Kirchoff asked regarding the curbing installed and was advised that a certain amount of line of sight variation <br />was consistent with the application and that the contractor who also serves as the City snow plowing contractor has been <br />advised that if he breaks it, he fixes it. <br />No comment from the City Council was received. <br />Motion by Bosak, Second by Rasmussen to adopt Resolution No. 2006-40 approving the assessment as presented <br />and ordering same to certify same to Ramsey County for collection was unanimously approved. <br />The Public Hearing was adjourned by Mayor Emeott at 7:22 PM. <br />AUTHORED: 14 November 2006 <br />APPROVED: 20 November 2006 <br />ATTEST: ATTEST: <br />Frederic C.
