VLAWMO budgets prepared by July 1 rather than June 15; <br />ii. Member budget meeting, with Members represented by an elected <br />official, prior to October 15 to review and comment on the proposed <br />budget and complete recommendation of the budgets to the Members; <br />Note: Local governments are required to set their preliminary <br />property tax levy, or September 15th; <br />iii. Member budget meeting could take place anywhere between July 1 <br />and Oct 151h, presumably between Sept 1 and Oct 15th, and after <br />completing each Member's operating budget; <br />b. Provide for final Member approval of the operating budget by Oct 15th rather <br />than the previous 60 day period after June 15th or July 1st. <br />c. Member Budget Meeting <br />i. Considering the calendar and dates above, the change calls for at least <br />one annual budget meeting of the elected official representatives of <br />VLAWMO Members to complete the budget recommendation to the <br />Members. <br />d. Methods of Financing VLAWMO - no change from previous versions <br />5. Membership - compared to the present Agreement, the proposed new Agreement does <br />not include the St Paul Regional Water Service/Board of Water Commissioners <br />(SPRWS/BWC) as a Member. SPRWS/BWC has attended some of the planning meetings <br />on the new Agreement, were asked to consider a proposal or make a proposal for their <br />financial contribution to the operations of VLAWMO, and declined to reply and have not <br />done so at the time I am writing this memo. <br />6. Financing allocation methods <br />a. Present- 40% valuation, 40% area and 20% population <br />b. Need to consider bases that relate to surface water management, such as impervious <br />surfaces as a contributing factor for drainage and runoff. <br />c. Special tax district - without state legislation, this is not a viable option at this time. <br />7. Dissolution <br />a. The references for dissolution in the earlier versions are incorrect in my opinion <br />and confuse the issue for application to MS Chap 103B for water management and <br />MS Section 471.59 relative to forming a joint powers entity by agreement. <br />i. Under Section 471.59, any Member choosing to leave the Agreement will <br />cause the Agreement to be terminated. Units of local government can be <br />participants without being Members, including having a financial <br />responsibility and involved in technical matters. <br />ii. The application of MS Chapter 103B is a separate matter with <br />responsibilities for local units of government that can be organized and <br />fulfilled with a WMO under a joint powers agreement as provided in MS <br />Chapter 103B or a watershed district as provided in MS Chapter 1031). <br />Member representatives completed a review of the last substantive draft of the Agreement, which <br />edits are included in this FINAL Copy.
