CITY OF GEM LAKE <br />MINUTES OF CITY COUNCIL MEETING <br />April, .1998 <br />The April meeting of the City Council of the City of Gem Lake was called to order by Mayor Enieott. on Monday, 23 <br />April 1998, at 7:06 p.m. in the first floor ineeting room of Tousley Ford. Mayor Emeott, Council Members Birkebak, Igo, and <br />Nielsen, 'Treasurer Nordstrom, City AttorneyNewcome, and Clerk Magnuson were present. Also present were representatives <br />of the White Bear Montessori School, Majestic Pines Church, and several members of the community. <br />Following Mayor Fmeott's request for additions,' deletions, or corrections, the following were unanimously approved <br />as presented: l) 23 February [998 Public Hearing on (Proposed) Ordinance No. 68 on Motion by Birkebak, Second by Nielsen; <br />2) 23 February 1998 Public Hearing on Revenue. Bond Financing on Motion by Nielsen, Second by Birkebak; 3) 23 February <br />I998 Council Minutes on Motion by:Birkebak, Second by Nielsen; 4) 16 March 1998 Council Minutes on Motion. by Nielsen, <br />Second by Birkebak; 5) 20 April 1998 Agenda with Recycling Report struck. on Motion by Igo, Second by Birkebak. <br />Mr. Cliff Aichinger made a presentation on behalf of the Ramsey Washington Metro. Watershed District (RWMWD), <br />statingresource management assistance in the planning and implementation process of watershed management. 146 noted Louise <br />Watson was available to assist the City in preparation of it's watershed management plan. <br />Magnuson reported on the pending settlement between Kadecltka and Kuehn as well as the pending Gerner .matter <br />regarding violations ;or the sewer ordinance and paymentof related fees. <br />Magnuson reported that Joel Schilling. has not responded to phone calls and that he (Magnuson) would continue to <br />attempt to communicate with Schilling regarding the development of the Watershed Management Plan. <br />Motion by Igo, Second by Birkebak to extend preliminary approval of subdivisions through November, 1998 to 1385 <br />East County Road E for Deluxe Corporation, 'flklaLarkin, was unanimously approved. <br />Motion by Igo, Second by: Nielsen toextend preliminary approval -of subdivisions through November, 1998 to 1430 <br />Goose Lake Road for Titcomb was unanimously approved. <br />Chairman Iloeschler''s .report to the: Council inthe form of a letter to Mayor Emeott dated April 14, 1998 was then <br />presented and is: attached hereto as Exhibit "A". <br />Following comments by Emeott, letters from residents of the neighborhood adjacent Majestic Pines Churchattached <br />as Exhibits "B and discussion regarding (Proposed) Revisions to Ordinance No. 43, Motion by Birkebak, Second by Nielsen <br />to accept the recommendations of the Planning Commissionand reject proposed amendments to the ordinance was unanimously <br />approved, <br />Based upon adoption of the previous motion and at the recommendation of Attorney Newcome and on Motion by <br />Nielsen, Second by Birkebak theapplication fora Special Use Pennit from White Bear Montessori School for use of the Majestic <br />Pines Property as a Montessori school was: unanimously denied as the use was not a permitted Special Use. Newcome urged a <br />letter stating same. <br />Mr. Schiller speaking on behalfof.the Majestic Pines Church asked why a religious school had been allowed on the site <br />in 1987. Magnuson recited excerpts :ofthe minutes from the approval stating that said approval was an interim response to a need <br />by a school the church had offered to help. When renewal â–ºvas required by the City, no application for same was received and <br />the matter was closed- Mr.. Schiller then commented on potential uses of the land: by the church including possible expansion <br />under previously approved city action. <br />Several members of the Montessori School.: spoke encouraging the City to take positive action in thematter to allow the <br />school to utilize the property. Members .of the community spoke generally in favor of theuse providing adequate codicils and <br />controls., can be einployed to limit expansion :of or on the site, Fortner .Planning Commissioner Bemis: stated he believes this is <br />an acceptable use of the property and encouraged the City to find a way to help theschool use the property. Emeott then discussed <br />the opportunity to develop andemploy an institutional overlay amendmentto the Zoning Ordinance. He ordered a working <br />session of the Planning Commission open to the public to develop the institutional overlay conceptand called for a public <br />Page 1 of. 2 <br />
