CITY OF GEM LAKE <br />MINUTES OF CITY COUNCIL MEETING <br />June, 1998 <br />The June meeting of the City Council of the City of Gem Lake was called to order by Mayor Emeott on .Monday, 15 <br />June 1998,. at7:12 p.m. in the first floor 1eeting roam of Tousiey Ford.Mayor Emeott, Council Members Birkebak, Kunin, Igo, <br />and Nielsen, Treasurer Nordstrom, and Clerk Magnuson were: present. Also present was Special Counsel David Kennedy, <br />members of the Planning Commission, representatives of the. White Bear Montessori School, and severalresidents of the <br />conrtnunity. <br />Following Mayor Emeott's request for additions, deletions, or. corrections,the following were unanimously approved. <br />as presented: 1.) 18 May 1998.Council Minutes on Motion by Igo, Second. by Birkebak; 2) I5 June 1998 Council Agenda on <br />Motion by lgo, Second by Kunin with Kunin variance'matters tabled to July.: <br />Magnuson then`. reported :Ori Kuehn/Kadeclika matter, presenting a Special Use Permit Application for grading of <br />previously filled material in accordancewith plans drawn by Bohrer Engineering firm and approved by Judge. Flynn as part of <br />a settlement betweenthe parties. Based upon the Citys previous offerings in this matter and upon motion by Igo, second by <br />Birkebak, Special Use Permit #98-02 was unanimously approved subject to the following conditions: 1) 2 copies of grading;, <br />landscape, and landscape protection plans by Bohrer are to be provided to the City Clerk; 2) all grading and landscaping: isto <br />be completed by 31 August 1998; 3) final grade:and landscaping is to be verified by Bohrer upon completion and a letter from <br />Bohrer indicating compliance with plans is to be submitted to the City Clerk; 4) a copy of Judge Flynn's final :settlement in the. <br />matter upon completion ofthe projectshall be sent to the City Clerk; 5) verification ofacceptance of the;. project by Kuehn and <br />Kadechka shall be: sent ty{ he City Clerk. <br />Magnuson then reported on the:Kuchenmeister matter, presenting a letter of finding by Ramsey. County Public Health, <br />a copy of'which is attached hereto as Exhibit "A". Magnuson then reported he and. Building Inspector Arend need to reinspect <br />the building for possible other violations: Following discussion and upon motion by Igo; second by Kunin, it was unanimously <br />determined that the City Clerk shall contact the.::City Attorney todiscuss whether condemnation:atilt building is appropriate. <br />Magnuson then reported on Gerner and Jurigmanviolations, and neighborhood inspections with no action taken. <br />Magnuson reported copies of Ordinance No. 72 distributed to the Council were for reference•only and that all changes <br />referenced have been incorporated into the copy of Ordinance No. 43 similarly distributed. <br />Mr. Hoeschlerthen reported that the Planning Commission hasreviewed the most recent revisions to..the site, landscape <br />and grading plans for the White Bear.Montessori School andthat all conditions required by the Planning Coinmission have been <br />met. Planshave been provided the City Engineer who will review same for drainage and discuss entrances: with Ramsey County <br />Public. Works,. said. reviews to becompleted by 19 June 1998. Magnuson indicated he has discussed the Developers Agreement <br />lequired with Attorney Newcoine III who; upon receipt of details: from Magnuson, will prepare thedocuments necessary by 19 <br />June 1:998, <br />The matter of Tax Exempt Revenue Bonds was then addressed. In accordance with Council mandate, Mr. David. <br />Kennedy of Kennedy and Graven Law Firm was appointed Special Counsel to the City. Mr. Kennedy's letter of 03 June 1998. <br />was referenced and is attached hereto as Exhibit "B”. Mr. Kennedy was then recognized and reconfirmed the findings in his letter <br />and also addressed several questions from the Council and those. present.. Deb Irvine then asked if Mr.. Kennedy should then. <br />complete the bond process and it was generally agreed that Ms. Remedios should complete the process with Mr. Kennedy <br />reviewing and guiding the City thus protecting the City's interests. <br />At 7:55 pni, .Public Hearing No. 98-02 of 23 Februaiy 1998 was then reopened. Additional commentswere received. <br />and written continents. from Robins and White Bear Montessori Schoolwere referenced. Mr. McPhillips was recognized and <br />supported the bond issue. Mr. Hoeschler was recognizedand supported the bond issue and further stated that he had spoken with <br />Mr. Bemis who similarly supported the bond issue. Mr. Nielsen was recognized and asked Mr. Kennedy questions which were <br />satisfactorily answered. Mrs. Robins indicated that Mr. Robins has spoken with Mr. Kennedy at length regarding the elements <br />of their correspondence to the City..
