CITY OF GEM LAKE <br />MINUTES OF CITY COUNCIL MEETING <br />May, 1998 <br />'1'he May meeting of the City Council of the. City of Gem Lake was called to order by Mayor Eineott on Monday, 18 <br />May 1998, at 7:10 p.m. in the first floor meeting room of Tousley Ford. Mayor Eineott, Council Members Birkebak, Kunin, [go, <br />and Nielsen, Treasurer Nordstrom, and Clerk Magnuson were present. Also present were representatives of the White Bear <br />Montessori School, Majestic Pines Church. and several members of the community. <br />Following Mayor Ern eon's .request for additions, deletions, or corrections, the following were unanimously approved <br />as presented: 1) 20 April 1998 Council Minutes on Motion by Ego, Second by Kunio; 2) 18 May 1998 Council Agenda on Motion <br />by IRO, Second by Nielsen. <br />taken. <br />Magnuson then reported on Kuehn/Kadechka matter, Gerner violations, and neighborhood inspections with no action <br />Magnuson then reported on status of Gem Lake Watershed Management Plan portion ofComprehensive.Municipal . flan. <br />A brief 1-35E Corridor Study Report was presented and is attached hereto as Exhibit "A". <br />Report of the Planning Commission in the form of letter to Mayor Emeott from Mr. Hoeschler attached hereto as Exhibit <br />"8" was then presented. Following a Special Workshop meeting on 27 April 1998, noticeof which was sent to all neighbors and <br />interestedparties, and a Public Hearing on. 11 May 1998 which was duly published, the Planning Commission recommended <br />implementation of Mayor Emeott's draft of an institutional overlay district as an ordinance tobeincorporated into the Zoning <br />Ordinance 443. While:a few minor changes were considered appropriate, none. of the changes recommended affected the spirit <br />and intent of the ordinance. Consensus approval of neighbors also weighed heavily in..the .recommendation. Sitedaspart ofthe <br />approval is Mr. Newcome's letters of 06 and 15 May .1998.attachedhereto as Exhibit "C". The Planning Commission also <br />recommended approval ofthe Site Plan for White Bear Montessori School with amendments to be presented to the Council by <br />Mr. Hi iger. <br />Magnuson. presented Application For A Zoning Variance from Daniel and Constance Kunin which has been received <br />with full fee payment. The application requests avariance from Ordinance No, 43, Section 7.5 (1) AREA. from three (3) acres. <br />to one (1) acre to accommodate and: allow the sale of the former Knutson residence: built on Kunin property as .employees <br />quarters. Magnuson referred to: action by the Planning Commission and City Council in 1980 which granted twosimilar variances <br />to existing former employee housing from the Daniels/Ward property, providing a third adjacent lot wasidentified which, when <br />filially split, would have adequate acreage to maintain a three (3) acre R-1 zoning density. Discussion of frontage followed and <br />the Kunins were asked to provide a map of the property showing what lot dimensions would be required for the variance to create <br />the one (1) acre lot. Contingent upon receipt of said drawings and a final survey showing same and upon motion duly made <br />(Birkebak) and .seconded (Nielsen), the variancewas unanimously approved with Kunin abstaining pending review of drawings <br />and with the requirement that subsequent subdivisions of adjacent lands must accommodate maintenance of of Three (3) acre <br />density by providing one or two lots of sufficient size (e.g• if a one acrelot split is allowed, one 5 acre or two 4 acre lots <br />immediately adjacent would be required to maintain density). A final survey shall also be filed with the City Clerk and Ramsey <br />County upon sale. <br />Discussion then followed regarding amendments andrecommendations to Mayor Emeoti's proposed revisions to the <br />Zoning' Ordinance.. Following discussion of several issues, it was determined that no changes were immediately necessary and <br />that the. (proposed) Ordinance as presentedmet the spirit and intent .of the effort as well as the goals of the Comprehensive <br />Municipal Plan and the Planning Commission. On motion by Igo, second by Birkebak, the :Council unanimously enacted <br />Ordinance No. 72 and ordered it to become effective upon publication. <br />Atthe recommendation of the Zoning Administrator and receipt of full fee payment, the Application For Consideration <br />of Zoning Request by White Bear Montessori School was then presented. Upon motion by Kunin, second by Nielsen, the <br />applicationallowingapplication of an Institutional Overlay to theproperty at 1201 East County Road. "E' , PIN 428.-30-22-44- <br />0006) was unanimously approved, subject to the following conditions: 1) review of the finalized site plan by the. Planning <br />Commission and City Engineer as well as Ramsey County (county road entrances only); preparation and execution of a <br />Developer's Agreement to be developed by the City Attorney. <br />Page 1 of 2 <br />
