MINUTES OF MEETING OF CITY COUNCIL OF CITY OF GEM LAKE January, 1995 The January meeting of the City Council of the City of Gem Lake was called to order on Thursday, 23 January 1995, at 7:30 p.m. in the first floor meeting room of Tousley Ford. Mayor -Elect Emeott, Councilmember Igo, Councilmembers-Elect Birkebak, Kunin and Nielsen, Clerk Magnuson, and Treasurer Nordstrom were present. Also present were Senator Linda Runbeck, Mr. Jim Johnston -Chairman of VLAWMO, Ms. Stephanie McNamara - Administrator VLAWMO, and Steve and Katrine Antolak of 3884 Scheuneman Road. Clerk Magnuson then introduced Senator Runbeck who then adminis- tered the Oath of Offices to newly elected City officials Emeott, Kunin, Nielsen and Birkebak, copies of which are attached hereto as Exhibits "A", "B", "C" and "D". Upon completion, the Council thanked Senator Runbeck for her presence and her efforts on behalf of the City. The minutes of the 08 December 1994 Truth -In -Taxation Hearing and the 08 December 1994 City Council Meeting were, upon motion duly made (Igo) and seconded (Nielsen), unanimously approved as presented. Upon motion duly made and seconded, the January Agenda was then approved. As the City Council had met jointly with the Planning Commission prior to the City Council meeting, the following matters were acted upon: 1) The Clerk was authorized to proceed with development of the Developers Agreement; 2) the Tousley Plan submitted to the Planning Commission on 15 December 1994 was, upon motion duly made (Nielsen) and seconded (Kunin), approved; 3) Variance No. 95-01 for Mike Gerner was, upon motion duly made (Igo) and seconded (Birkebak) approved as recom- mended by the Planning Commission. Mr. Johnston and Ms. McNamara were then recognized as present in response to Mayor Emeott's letter of 05 January 1995 to VLAWMO, a copy of which is attached hereto as Exhibit "E". Mayor Emeott asked both parties to explain to the Council why Gem Lake should continue partici- pation in VLAWMO. Both parties stated that by legislation, the City must maintain a watershed ordinance and/or agency. If Gem Lake does not participate in VLAWMO and RWMWD, it must establish it's own ordinance and agency or the City will be made part of the County/State district and will then be assessed at a rate far greater than cost in VLAWMO and RWMWD. After presentation of materials, Mayor Emeott thanked them for being present and suggested the issue be tabled to February. Mr. and Mrs. Antolak were then recognized. They stated their pur- pose in being present was to determine their ability to obtain access to the city's sanitary sewer system as their septic system is in need of replacement. The Antolak's along with their neighbors, Lisa and Mike Hurt (3880 Scheuneman Road), have discussed connection to the intercep- tor with White Bear Lake which would require a joint powers agreement and several arrangements with White Bear Lake. It was suggested that the parties examine the proximity of the manholes relative to their respec- tive properties. If manholes are reasonably close, private connections to the manholes similar to the north end of Scheuneman would be the most cost effective method of connection. An easement along Scheuneman Road might also allow for a private sewer line. Mayor Emeott and the Clerk will work with the parties to determine how best to resolve the issue. 01
