This agreement has been thoroughly reviewed by the City Attorney and attorneys from the
League of Minnesota. Cities and Suburban Rate Authority.
Policy objectives: Utilities within public right-of-ways are governed by the City's Right-of-way
Management Ordinance (Chapter 707 of the City Code) or, as is the case with natural gas,
electric and cable TV, by individual franchise agreements. The proposed Metricom agreement
is not a franchise agreement and does not supercede the requirements of the Right-of-way
Management Ordinance. Rather, it proposes to pay a rate equal to or higher than that required
in the Right-of-way Management Ordinance as compensation for City management costs.
Financial implications: The total anticipated revenue from this agreement is fairly modest.
However, without the agreement, the City would be limited to fees collected through the Right-
of-way Management Ordinance. If the revenue collected through the agreement is less than
the fees that would be collected through the Right-of-way Management Ordinance, the City
has the option to utilize the Right-of-way Management Ordinance.
RECOMMENDED COUNCIL ACTION:
Approval of an agreement with Metricom, Inc. to allow the installation of a wireless
communications network in Roseville and authorizing the Mayor and Manager to sign the
agreement on behalf of the City.
Prepared by: Karl Keel
