permit Tenant to surrender this Agreement or shall relieve Tenant from its liability under the <br /> terms and conditions of this Agreement including payment of Rent, and Tenant waives any <br /> rights now or hereafter conferred upon it by statute or otherwise to quit or surrender this <br /> Agreement or the Facility or Improvements. <br /> Tenant agrees to protect and save Lessor from any claims for injuries to property or <br /> person, or death, resulting from accident or other happening on the Property, and to carry <br /> comprehensive general liability insurance in the. amount of$1 ,000,000.00 to protect both Lessor <br /> and Tenant. During the Term, Tenant shall maintain insurance in the above-specified amount or <br /> in an amount equal or greater to the cumulative damage limitation established in Minnesota <br /> Statutes Chapter 466, or such other amount approved by Lessor in writing. Lessor shall be <br /> named as an additional insured on the policy. Such insurance shall be written in a company or <br /> companies authorized to- engage in the business of general liability insurance in the State of <br /> Minnesota, and there shall be delivered to Lessor customary certificates evidencing such paid-up <br /> insurance, which certificates are to be issued by the insurance companies and which certificates <br /> shall further provide that such liability insurance may not be cancelled unless Lessor is notified in <br /> writing ten (10) days prior to any such proposed cancellation. <br /> 13. UTILITIES. Tenant shall be responsible for securing the provision of any utility <br /> services and for the payment of all utility costs including but not limited to sewer, water, gas, <br /> electric, refuse and cable television. Lessor shall grant any additional easements necessary to <br /> serve Property with utilities, said easement locations to be determined by Lessor. <br /> 14. REAL PROPERTY TAXES AND SPECIAL ASSESSMENTS. Tenant shall <br /> pay any applicable taxes together with installments of special assessments relating to the use of the <br /> Property by Tenant.
