specifications, and maintained in a safe and sanitary manner in full compliance with all applicable <br /> laws, ordinances and codes, and shall maintain the property and Improvements consistent <br /> with Lessor facilities and public areas. If Tenant fails to maintain the property or <br /> Improvements as required by this Paragraph, as determined by Lessor, the Lessor may <br /> enter the property or Improvements following reasonable notice and opportunity to cure <br /> which shall not be less than forty-eight (48) hours for non-structural violations and thirty <br /> (30) days for structural violations, repair or remedy the violation, which costs incurred by <br /> the Lessor shall be due and payable within 90 days . Failure by Tenant to pay Lessor within <br /> 90 days shall constitute a default. <br /> 9. HOURS OF OPERATION. The Facility may be open only during the hours of <br /> 5 a.m. to 10 p.m. for public access, business and support deliveries, and maintenance, except as <br /> expressly authorized by the Lessor in writing. Staff and volunteers may use the facility outside <br /> the above-stated hours as needed for veterinary care, but shall not admit or discharge animals <br /> outside the above-stated hours except in the case of emergencies. <br /> 10. ASSIGNMENT AND SUBLETTING. During the term of this Lease, Tenant <br /> may not, assign this Lease or any interest herein, or sublease all or any part of the Property, or in <br /> any way allow any other person to use its facilities. <br /> 11. INDEMNIFICATION OF LESSOR. Tenant shall indemnify and save harmless <br /> Lessor from and against all liabilities, obligations, losses, damages, penalties, claims, actions, <br /> suits, costs, charges, and expenses, including attorney's fees, which may be imposed upon, <br /> incurred by or asserted against Lessor in respect to any use, nonuse, or condition of the Property <br /> created by Tenant or attributable to Tenant's use or manner of use of the Property.
