improvement to be placed on the Property or to be rebuilt thereon unless it shall be stipulated in <br /> and be a condition of such contract that no lien shall arise or be claimed against the Property on <br /> account of such contract or on account of any work done or material furnished under the contract. <br /> Tenant agrees to provide evidence to Lessor that Tenant has raised sufficient funds to <br /> make all of the improvements in the -plans needed to provide a safe and secure Facility prior to <br /> beginning construction. Tenant shall pay all customary permit fees and other charges imposed by <br /> the Lessor. At Lessor's discretion, Tenant shall deposit all construction funds with a title <br /> company or other disbursing agent to ensure the security of construction financing, and shall enter <br /> into a disbursement agreement with the title company or disbursing agent acceptable to both <br /> Lessor and Tenant. Tenant shall pay all charges imposed by the title company or disbursing <br /> agent. Tenant shall not encumber the Property with any mortgage or secure any other debt <br /> regarding the facility or Improvements. <br /> 7. USE. The Facility will function as both a not for profit wildlife veterinary <br /> hospital and a not for profit public education center operated exclusively by the Wildlife <br /> Rehabilitation Center of Minnesota. Tenant may use part of the facility as a gift/bookstore.No <br /> change in use or significant change in operations may be made by Tenant without the express <br /> written authorization of the Lessor. Tenant shall make the public education center portion of the <br /> Facilities available on a scheduled, space-available basis for use by the Lessor. Lessor shall <br /> coordinate programs and activities with an intent to minimize and manage parking and traffic <br /> concerns. <br /> 8. COVENANTS,REPRESENTATIONS,AND WARRANTIES.
