REQUEST FOR COUNCIL ACTION <br /> BATE. 04/12/99 <br /> ITEM ■ <br /> Depart ent roval: Manager Approved: Agenda Section. <br /> Land Use <br /> Item Description: Moratorium Shopping Center Impact Study(PF 3113) <br /> 1.0 Requested Action <br /> The Council adopted an interim ordinance to allow for time to complete studies on the impacts <br /> of shopping centers adjacent to residential areas,including the issues (and solutions) that may <br /> arise from 24 hour operation.A study is proposed that would address many of these issues.The <br /> City Attorney drafted amendments to the interim moratorium ordinance for consideration by the <br /> Council(see the attached ordinance and correspondence from the City Attorney). <br /> 2.0 Background <br /> 2.1 Based on the discussion by the Council,public input and staff suggestions, a number of <br /> issues will be studied in more detail to determine whether additional regulatory control <br /> is necessary.(on 2 of 3 previous new grocery shopping complexes,a special use or Planned <br /> Unit Development permit were used.)The original zoning code shopping center district <br /> designations and regulations did not foresee the intense uses that may occur}nor did the <br /> original code anticipate a 24 hour life style and accompanying retail mode of operation. <br /> Finally,it is not clear in the zoning code whether the major warehouse-sized,subregional <br /> grocery shopping center was anticipated. Currently there is not an opportunity to use a <br /> permit system to assure that improvements are made to a site to mitigate the impacts of <br /> such uses. <br /> 2.2 For example, Roseville's conditional use permit process (Section 101 3 of the City Code) <br /> allows the City to consider: <br /> compatibility with adjoining properties; <br /> impacts on traffic and public facilities} <br /> impacts on property values; <br /> • impact on the general health,safety,and public welfare; <br /> • compatibility with the City's comprehensive plan. <br /> The process also allows the City to impose those conditions it considers necessary to <br /> protect the public health}safety,and welfare. <br /> 2.3 The variance process requires the applicant to demonstrate a physical hardship and to <br /> demonstrate that no practical alternatives exist that would reduce the need for a variance. <br /> Conditions may be attached. <br /> PF3113-RP CA(04-12-99)-Page 1 of <br />
