r <br /> AGREEMENT <br /> This Agreement, between the State of Minnesota, acting by and through the Commissioner of the <br /> Department of Natural Resources, hereinafter referred to as the "State", and the city of Roseville, <br /> hereinafter referred to as the "local unit of government". <br /> WITNESSETH: <br /> WHEREAS, the Commissioner of Natural Resources has the authority, duty, and responsibility <br /> under Minnesota Statutes Section 97A.141 (1996)to provide the public with free state water access sites <br /> on lakes and rivers where access is inadequate; and <br /> WHEREAS, additionally, the Commissioner of Natural Resources has the authority, duty, and <br /> responsibility under Minnesota Statutes Section 97A.065, Subdivision 3 {1 996}to provide the public with <br /> fishing piers; and <br /> WHEREAS, the State and the local unit of government are authorized under Minnesota Statutes <br /> Section 471.59 (1998)to enter into agreements to jointly or cooperatively exercise common powers; and <br /> WHEREAS, the local unit of government and the State have determined that a fishing pier site on <br /> Langton Lake hereinafter referred to as the"Fishing Pier" is of high priority under the state public water <br /> access program; and <br /> WHEREAS, plans for the Fishing Fier have been developed and approved by the State and are <br /> attached hereto as Exhibit"A!'and shall be referred to as the"Plan", and <br /> WHEREAS a Fishing Pier site location on Langton Lake has been selected by the State and local <br /> unit of government as shown on the map attached hereto as"Exhibit B" and is legally described as shown <br /> on "Exhibit B" and <br /> WHEREAS, the State and local unit of government desire to cooperate in the installation and <br /> maintenance of the Fishing Pier on Langton Lake. <br /> NOW, THEREFORE, in consideration of the mutual benefits to be derived by the public bodies <br /> hereto and for the benefit of the general public, the parties agree as follows: <br /> INSTALLATION <br /> Installation of the Fishing Pier structure itself shall be the responsibility of the State, <br /> however, the local unit of government shall provide personnel and equipment when <br /> feasible to assist with the installation. The local unit of government will construct and pay <br /> for a concrete footing and approach at the shoreline connecting the gangway to the shore. <br /> The local unit of government will also construct and pay for a Lard surfaced, accessible <br /> sidewalk/path connecting the Fishing Pier to an accessible parking space. The local unit <br /> of government agrees to complete their portion of the project within one year of the <br /> � effective date of this Agreement. <br />
