III OPERATION OF THE FISHING PIER <br /> The local unit of government shall operate the Fishing Pier in the following manner: <br /> A. The local unit of government shall comply with all local, state, and federal laws, <br /> regulations, rules} and ordinances which may apply to the management, <br /> operation, and maintenance of said premises. <br /> B. The Fishing Pier may only be used for fishing, observation and other compatible <br /> uses. <br /> C. The Fishing Pier and related facilities shall be free and remain open every day <br /> during open water season for at least sixteen (16) hours per day between the <br /> hours of 6:00 a.m. and midnight or in conjunction with existing and established <br /> local unit of government hours of use for its park facilities. The Fishing Pier may <br /> be closed by the local unit of government in emergency situations or with the prior <br /> written consent of the State. The State shall be notified within three (3) days if <br /> the Fishing Pier is closed for emergency reasons. <br /> D. Free and adequate parking in the vicinity will be provided for the Fishing Pier <br /> including at least one designated accessible parking space for persons with <br /> disabilities. <br /> E. The State reserves the right to inspect the premises at all times to insure that the <br /> local unit of government is in compliance with the terms of this Agreement. <br /> F. The local unit of g ovem rnent shall provide police protection in accordance with <br /> the local unit of government's customary practices in providing for the local unit of <br /> government's public park areas. <br /> G. The State shall post a sign informing the public that the Fishing Pier is <br /> cooperatively provided by the local unit of government and the Minnesota <br /> Department of Natural Resources. <br /> H. The State shall retain ownership of the Fishing Pier and retains the authority to <br /> relocate and/or remove the Fishing Pier if the site (Exhibit"B") is determined to be <br /> inadequate or if the local unit of government fails to comply with the terms of this <br /> Agreement. Before such removal or relocation, the State shall consult with the <br /> local unit of government. <br /> ® The local unit of government shall mane a good faith effort to keep the Fishing <br /> Pier in cioan and sightly order in accordance with the local unit of government's <br /> customary practices for the maintenance of public park areas. Additionally, the <br /> local unit of government shall provide all necessary routine maintenance and <br /> minor repairs including but not limited to the repair or replacement of decking and <br /> railing.
