WHEREAS, the Roseville City Council held a hearing on September 26, 2011, to determine whether or not the portions of said Highcrest Road and Terminal Road described above should be vacated; and WHEREAS, the Roseville City Council has determined that the vacation of those portions of Highcrest Road and Terminal Road described above would be in the public interest; and WHEREAS, four-fifths of all members of the City Council concur in this resolution; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ROSEVILLE, MINNESOTA: 1. That the City of Roseville hereby vacates those portions of Highcrest Road and Terminal Road legally described as follows: PART "A"—A strip of land Fifty-five (55) feet in width lying parallel and adjacent to and East of the West line of the Southwest Quarter (SW 1/4) of Section Eight (8), Township Twenty-Nine North (T29N), Range Twenty-Three West (R23W), and beginning at a line which is Thirty (30) feet South and parallel to the North line of said Southwest Quarter (SW 'A) of Section Eight (8), extending South to a line which is Seventy (70) feet Westerly and parallel to the Westerly right-of-way of The Minnesota Transfer Railway Company; and, PART `B" — A strip of land Sixty (60) feet in width, lying Thirty (30) feet of such width on each side of the East to West Quarter line of Section Eight (8), Township Twenty-Nine North (T29N), Range Twenty-Three West (R23W), and beginning at the West line of said Section Eight (8), extending East to a line which is Seven Hundred (700) feet East and parallel to the West line of said Section Eight (8), Township Twenty-Nine North (T29N), Range Twenty-Three West(R23W), Excepting so much of said Part "B", above described, which lies within Eight and Five-Tenths (8.5) feet on each side of a line which is Three Hundred Seventy-Seven and Five-Tenths (377.5) feet East and parallel to the West line of Section Eight (8), Township Twenty-Nine North(T29N), Range Twenty Three West(R23W). 2. The vacation applies only to those portions of Highcrest Road and Terminal Road legally d ascribed in Provision 1 above which were acquired by the City of Roseville pursuant to a deed filed in the office of the Ramsey County Recorder as Document No. 1588417, and not: (a) to the rights of existing utilities, if any, within the area vacated, or(b) any other easements running to or benefitting the City of Roseville. 3. The City Manager is directed to record a notice of completion of these vacation proceedings pursuant to Minnesota Statutes §412.851.
