EXTRACT OF MINUTES OF MEETING OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br /> of Roseville, County of Ramsey, Minnesota, was held on the 26th day of September 2011 at 6:00 <br /> p.m. <br /> The following Members were present: Willmus, Pust, McGehee, Johnson, and Roe; <br /> and none were absent. <br /> Council Member Johnson introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 10935 <br /> A RESOLUTION APPROVING DRIVE-THROUGH FACILITY AS A CONDITIONAL <br /> USE AT 2435-2459 RICE STREET (PF11-021) <br /> WHEREAS, BHJN, LLC, applicant for approval of the proposed conditional use, owns <br /> the property at 2435-2459 Rice Street, which is legally described as: <br /> PIN: 12-29-23-14-0089 <br /> Transit rd Addition, subject to drive easement, Lots 1 and 2 Block 1 <br /> WHEREAS, the Roseville Planning Commission held the public hearin g regarding din the <br /> g g <br /> proposed CONDITIONAL USE on September 7, 2011, voting 6-0 to recommend approval of the use <br /> based on the comments and findings of the staff report prepared for said public hearing; and <br /> WHEREAS, the Roseville City Council has determined that approval of the proposed <br /> CONDITIONAL USE will not result in adverse impacts to the surrounding properties based on the <br /> following findings: <br /> a. While a drive-through facility as proposed might not advance the goals of the <br /> Comprehensive Plan aside from representing continuing investment in a <br /> commercial property, it does not conflict with the Comprehensive Plan; <br /> b. The proposed use is not in conflict with a Regulating Map or other adopted plan <br /> because no such plans apply to the area surrounding the property; <br /> c. The proposed use is not in conflict with City Code requirements since permits will <br /> not be issued if the plans fail to meet all of the relevant requirements and, <br /> moreover, the conditional use approval can be rescinded if the use or the property <br /> fails at any time to comply with all applicable Code requirements or conditions of <br /> the approval; <br /> d. As a common kind of retail use in a long-standing retail location, the proposed use <br /> would not have significant impacts on any parks, streets, or public infrastructure; <br /> e. The potential for some additional traffic and noise related to the drive-through <br /> audio equipment seem to be the only sources of impacts to surrounding properties, <br /> Page 1 of 4 <br />
