EXCERPT FROM PLANNING NIN COMMISSION INUTE OF 8112198.
6b. Planning File 3036. John and Moneil Jakel are requesting variances to
reduce the front yard setback of an accessory building to 13 feet and
increase the coverage of the required rear yard from 5% to 38.4% for the
purpose of constructing a 4' 36" (864 sf) garage at 3170 West Owasso
Boulevard.
Chair Harms opened the public hearing and requested Dennis Welsch to present
a summary, based on written reports dated July g, 1998, of the request for
variances. Dennis Welsch advised the purpose of thia variance request was to
replace an existing garage; this site had two frontages and no rear setback
because of the lake; the new garage would be an improvement to the site; that a
front yard variance would be 17', building size variance would be 301.5 square
feet, lot coverag ewo u Id expand to 38% instead of 25%; that s i d eyard setbacks
would be met and that topography was a big issue in the variance request.
Member Mulder asked if asphalt driveway would be replaced (yes with temporary
pavement now).
Member Mulder asked if the garage could be placed to the other side; Mr. Jakel
advised it could but this placement world block the neighbor's view of the lake.
An oak tree would be removed.
Motion: Member Mulder moved, Member pausing seconded, to recommend
approval of.John and Monell Jakel's request for variances to reduce the front
yard setback to 13 feet, to allow the placement of an accessory building in the
front yard area of a lakeshore parcel, and to increase the lot coverage to 38.4%
of the required rear yardfo r the purpose of constructing a 4' x 36' (864 square
foot) replacement garage at 3170 West Owasso Boulevard, based on the
following findings:
1 Setion 1004.02D (4) requires a front-yard setback, of no less than 30 feet.
Because of the topography of the parcel, a garage is needed up by the
roadway. Meeting the 30 foot setbck requirement would require extensive
filling on a lakeshore lot, which would affect the drainage on this property
and adjacent properties. The proposed garage will be setback 1 feet
from the front property line.
2. Section 1004.01 (A) requires accessory buildings to be placed in the rear
yard. Since this property is a lakeshore lot, it does not have a true rear
yard. The roadway side of the parcel is classified as a front yard and the
lakeshore side of the parcel is subject to the city's shoreland setback
requirements.
Section 1004.01 (A) also limits the size of an accessory building to % of
